Businesses, both small, locally owned and large here in the community and working together with each of you to make that possible 00:04:28

And I am here today to share a timeline of events of some issues I have been currently having and still having. 00:05:28
With the Valencia County Sheriff's Department. 00:05:35
On June 26th at 2311 I contacted the non-emergency dispatch requesting an officer to my residence. 00:05:38
To file a report of assault and threats of bodily harm from a local farmer who had been drinking. 00:05:46
And assaulted me as I stood on my property behind my pipe fencing. 00:05:51
2318 dispatch called me back. 00:05:55
Patched through a call from Deputy Shane. 00:05:58
I told him what happened, explained on multiple times through the conversation that he had been drinking, assaulted me, threatened 00:06:01
me bodily harm and was still sitting on the ditch bank behind my home. 00:06:06
Zero response to my home. 00:06:12
On 6/25 I sent a message via Facebook Messenger to show Sheriff the hill with limited to no details, letting her know that I'd had 00:06:15
an issue. 00:06:19
With how they call was handled and I was instructed to call and ask for a Sergeant on duty. 00:06:24
And that I was welcome quote. 00:06:28
Well, UN quote. I was welcome to file a complaint and we can look into it for you. 00:06:31
625 I called non-emergency at 1314 and requested the Sergeant on duty Returned my call. 00:06:36
At 3:00. 00:06:43
And 6:25 at 1331 Sergeant Brown returned my phone call. 00:06:44
During my 19 minute, 8 second phone call, I was basically scolded being told that I would not have been assaulted had I not 00:06:49
engaged with the farmer verbally. 00:06:54
On 6/26 at 11:15, Lieutenant Espinoza called me unsolicited, maybe at the request of the Hill, I'm not sure. 00:07:00
To follow up with my message. 00:07:09
But he wanted me to wait another two days from there. 00:07:11
For Deputy Shane to come back on duty and have him deal with the situation that he should have already dealt with two days 00:07:14
previous when I called. 00:07:18
On 6/26 at approximately 12/30/13 hundred. 00:07:23
After denying that that was acceptable to Espinoza the day before. 00:07:28
He sent out officers Deputy Lyle and Deputy Baca, who responded to my residence. 00:07:32
Interviewed me, investigated, looked at what my claims were and also looked at a video and from that video determined. 00:07:38
That criminal. 00:07:46
Charges be filed against the individual that assaulted me. 00:07:47
But then on 6/29? 00:07:52
I turn in a typed formal complaint against Deputy Shane. 00:07:54
And Sergeant Brown not only to the Valencia County Admin Office across the street, but to the County Managers office down the hall 00:07:59

To inquire about my complaint. I was told it would be locked, looked into and someone would call me back. 00:08:42
8/18/23 at 1019 I called again. 00:08:50
And checked on the status of my complaint, since I had still not heard from anyone in regards to my complaint whatsoever. 00:08:55
I was told. 00:09:02
That both Denny Monette and then also Michelle Lachelle. 00:09:03
As a follow up had spoken to the Undersheriff. 00:09:08
Jeff Noah and is aware of my complaint and should expect to hear back from Noah soon. 00:09:11
On 8/18/23 at 1023. 00:09:17
I left a detailed voicemail for Noah and requested he call me back. 00:09:21
On 8/24/23 I had the hearing. 00:09:26
For the restraining order and was attempting to obtain. 00:09:29
Against the individual that assaulted me. 00:09:33
To my surprise, both Sergeant Brown and Deputy Shane showed up as a witness for the opposing party. Sergeant Brown condoned the 00:09:35
assault yet again from the witness. 00:09:39

By stating under oath that he had done the same thing, he would have done the same thing. 00:09:46
Assault is illegal. Is illegal. Is illegal. 00:09:51
Period. And to have Valencia County Sheriff's Sergeant condone the actions is despicable, to say the least. 00:09:55
On 8/28/23 at 9:17, I again called the county manager's office and spoke to. 00:10:02
Lachelle told her I would like a meeting with Danny Monette. I was told that. 00:10:08
Mr. Barnett schedules his own appointments and she would notify him of my request. 00:10:12
On 8/28/23 at 10:59 I received a phone call from Chief Deputy. 00:10:18

Full of attitude and obviously annoyed that he was the person who had the task of returning my phone call in regards to the 00:10:25
complaint filed at 6/29/23. 00:10:30
A day start of two months since the complaint had been filed, I was told that all of my complaints have been found. 00:10:35
Unsubstantiated. 00:10:41
On 8/28/23. 00:10:43
At 1134, I received a second phone call from deputy. 00:10:44
Perrone allowing that he. 00:10:49
Had missed some of the notes and a couple of the complaints have been found to be substantial. 00:10:52
And that the parties involved have been spoken to in regards to my complaint I asked for. 00:10:58
That in writing for the Valencia County Sheriff's Office website policy. 00:11:03
For formal complaints, Chief Deputy Tyrone said it was his fault the letter had not been sent out and would get one out sent out. 00:11:07
On 8/31/23 I received what I will refer to as a generic form letter signed by Sheriff Hill herself. 00:11:14

On the hospital. 00:12:45

I have a statement that I can read or I can just briefly brief the Commission on on what we can share so. 00:12:48
If you'll recall, back in the special session and the 3rd special session 2021. 00:12:55
The legislature appropriated. 00:13:01
$50 million for the construction of the hospital here in Valencia County. 00:13:03
Within several months of. 00:13:09
Then passing that, we negotiated a contract with DFA. 00:13:11
By which we would secure reimbursement for expenditures made. 00:13:15
Of those appropriated funds. 00:13:19
Shortly thereafter, in mid March of 2022, the county directed the preparation of a solicitation to identify provider, believing 00:13:21
that it would be more appropriate to have a provider on board who can help the county to. 00:13:28
Design and develop and implement a hospital that would meet the needs of the provider rather than one that the county thought it 00:13:35
might need. 00:13:39
So we issued the RFP in August 2022. 00:13:43
Umm. 00:13:49
Received, I mean, we issued it back in March 2022. We received the responses in August 2022. 00:13:50
And since that time we've been negotiating with the provider, the, the healthcare facilities contract. 00:13:56
And pursuant to the Procurement Code, the contents of competitive seal proposals are not subject to disclosure during the. 00:14:03
A negotiation period, which is why it's still on executive session while we're continuing to discuss the negotiation of the 00:14:11
healthcare facilities contract and executive session. 00:14:15
But the work has continued and I want to share what what's gone on since then. 00:14:19

We identified a challenge you know and and working through the the the healthcare facilities contract with the provider that we 00:14:25
brought to our legislative delegation this past session. 00:14:29
In January and that resulted in both an extension of the time within which we had to expend the proceeds, the the, the, the 00:14:34
appropriation proceeds until 2026. 00:14:39
And also allowed for the use of 5% of the appropriated funds for pre opening expenses. 00:14:44
We're continuing to work through a couple of other obstacles. 00:14:50
Presently. 00:14:54
As it relates to the the actual design and construction of the hospital, of course we don't want to sit and wait to hammer out the 00:14:55
details of the healthcare facilities contract. 00:14:59
Or to to get started on the actual construction component of the hospital, because we do have a fixed time within which we can get 00:15:03
this constructed. 00:15:07
Accordingly, we issued phase one of the design build for the hospital. 00:15:12
And we've taken the input of and we've cooperated and coordinated with the hospital and their folks to to help to incorporate 00:15:17
their needs into that design build. 00:15:21
And this the county is shortlisted. 00:15:27
Design build offer from phase one. 00:15:30
The architect is presently working on the phase two for the design build and we hope to have that on the street by the end of the 00:15:32
month and to have a contract awarded. 00:15:37
For the construction by December. 00:15:42
So that's the update that I have for the board and I stand for any questions. 00:15:44

And and like I said, Lena was very courteous to allow me to utilize them to. 00:16:46

All right. Well, thank you for having us. This is Natalie. She's 14 years old. 00:20:08

She was diagnosed. 00:20:14
With brain cancer in 2019. 00:20:16
She's been battling ever since. 00:20:19
Most recently, she got diagnosed with a third brain tumor in. 00:20:22
January. 00:20:27
She just had brain surgery on August 18th, if you could believe that. She was so good. She's doing so well. 00:20:29
So now we just. 00:20:37
They're going to start the next phase of treatment which will probably start like on the 18th of September. So anyway, we just 00:20:39
want to, you know, thank you guys for doing this for us. 00:20:44
First, Children's Cancer Fund of New Mexico. They're so supportive and like such an awesome organization for. 00:20:49
Children and families. 00:20:56
They have to go through this. 00:20:57
You know. 00:20:59
This diagnosis that nobody ever wants to go through, but we just. 00:21:00
I just appreciate it and it helps families like this. 00:21:05
Get through it, but without the support and the. 00:21:10
Umm. 00:21:13
You know, the awareness. 00:21:14
We couldn't do that. There's so much. 00:21:17
There's so much that. 00:21:19
People don't know about childhood cancer. 00:21:21
You know, we hear about breast cancer, we hear about all that, but. 00:21:24
Only 4% of funding goes to childhood cancer. 00:21:28

Awareness and you know, research rather and. 00:21:33
We just want to get it out there because our kids are our future and it's so important. 00:21:36
And. 00:21:41
You know, we need better treatments. We need safer treatments and. 00:21:42
The support of our Valencia County community has been tremendous. I mean, I I put it on Facebook and I have a lot of friends and 00:21:47
it gets shared and. 00:21:51
You know, we've had so much support. We love our, we love our county so. 00:21:55
You know, I've been here my whole life. 00:22:00

So it starts, whereas the Valencia County Board of Commissioners met upon notice of a business meeting. 00:22:56

On Wednesday, September 6th, 2023 at 5:00 PM. 00:23:10
As required by law and whereas childhood cancer is the leading cause of death. 00:23:14
By disease in children and whereas one in 285 children in the United States. 00:23:18
Will be diagnosed by their 20th birthday and. 00:23:23
Whereas 46 children per day. 00:23:26
Or 16,790 children per year are diagnosed with cancer in the US. 00:23:28
And whereas at least one child from New Mexico is diagnosed with cancer each week. 00:23:33
And whereas 13 children from Valencia County are currently being treated. 00:23:38
For childhood cancer in Albuquerque and whereas the average age of diagnosis is 6 years old. 00:23:42
And whereas 80% of childhood cancer patients are diagnosed late. 00:23:47
And with metastatic. 00:23:52
Disease and whereas on an average there's been a .6% increase. 00:23:54
In incidents per year since the mid 1970s, resulting in an overall incidence increase of 24%. 00:23:59
Over the last 40 years and whereas 2/3 of childhood cancer patients. 00:24:05
Will have chronic health conditions as a result of their treatment toxicity. 00:24:09
With one quarter being classified as severe to life threatening and. 00:24:14
Whereas approximately 1/2 of childhood cancer. 00:24:17
Families rate the associated financial toxicity due to out of pocket expenses. 00:24:20
And considerable to some beer. 00:24:26
Whereas in the last 30 years, only 60 drugs have been approved by the FDA to specifically treat childhood cancer. 00:24:28
Whereas researchers and healthcare professionals work diligently. 00:24:35
Dedicating their expertise to treat and cure cancer children with cancer. 00:24:39
And whereas too many children are affected by this deadly disease. 00:24:43
And more must be done to raise awareness and find a cure. 00:24:47
Now, therefore, be the Board of County Commissioners of Orange County. 00:24:50

If you look at that, there's a few items that have been added to that list. 00:27:42
And these are out of necessity. One is. 00:27:46
For the Sheriff's Office, the lieutenants. 00:27:49
I I will take the blame for it being my oversight when we did the raises this last year. 00:27:52
Everybody got raises other than the lieutenants got a 5% when the rest of the department got 12 1/2 and it's created some 00:27:57
compression wage compression. 00:28:02
So it would be a total cost of $41,591.21 to bring up them up to the 12.5%. 00:28:07

Court security officers. 00:28:19
We have not had an applicant for court security in five or seven. 00:28:21

And that's for Valencia County, Los Lunas, Berlin, Real Communities, Bosky Farms and Peralta. 00:29:25

The county has those last about 45 minutes and then. 00:29:32
We have no units available in the rest of the county. 00:29:37
Our fire units have been transporting quite a few patients lately and unfortunately we've had some scenes. 00:29:39
Where our crews are on scene in basically a fire engine. 00:29:47
And don't have the opportunity to take a patient to the hospital. It needs to go. 00:29:52
Usually that's because. 00:29:56
They're clearing off of another call. Something's going on, but what we're looking to do is, is add two more ambulances into our 00:29:58
fleet. 00:30:02
That way we have the necessity and the ability to transport patients as they come up which. 00:30:07
Again has been has been much more frequent and we anticipate is going to. 00:30:12
Stay the same, if not get a little bit worse. So we're trying to get ahead of that problem by adding these vehicles into the fleet 00:30:18
we can we can start to overcome that and create a long term strategy for. 00:30:23
Of being sustainable in the county. 00:30:29

And one or two of the municipalities had theirs out. So we had no coverage around the county whatsoever and I think this is a 00:31:22
safety issue for the county. 00:31:25

These responses crossing jurisdictional boundaries. 00:34:33

What we have agreed on is the fact that right now that's the only way to stay sustainable in the county is. 00:34:38
The partnership with each other but. 00:34:45
We also have to be cognizant of our obligations. So for instance, if Berlin needs assistance and we're. 00:34:47

We may not be able to provide that unit because our obligation is to keep those units in the county and same thing goes with the 00:34:55
municipalities if we reach out to them. 00:34:58
And they're Downing unit. They may, they may deny that request to us. 00:35:03

Is creating a policy for drop off at the hospital so if we bring a patient who's stable, no critical threat? 00:37:02
Basically saying, hey, after 15 minutes we're going to give the run sheet to the admitting people, we're going to sit the patient 00:37:10
in the triage area and we're going to clear our unit out. 00:37:14
Obviously if the patient is. 00:37:19
Is not stable, then that goes out the window and we will stay with them until they get the turnover. But. 00:37:21
What we've been finding is, you know, we we transport a lot of very sick people out of this county and our units get stuck for. 00:37:26
An hour, sometimes two hours at the hospital waiting for a bed to open up. So. 00:37:33
That plays part of the problem. You know, this new direction we're going with with cutting that down will help a bit, but. 00:37:40
You know, the patients we're seeing are not. 00:37:48
You know, abusing the system. They're really in need, so. 00:37:52

As a result, Valencia County was awarded $225,000. 00:47:23
To partner with an Internet service provider. 00:47:27
And provide free wireless Internet to residents in our disadvantaged communities of Meadow Lake and El Cerro. 00:47:30

The county did have an MO U executed with Locket. 00:47:40

The resolution before you this evening is to dissolve the current fire district set up that we have in one city county. 01:04:52
Currently. 01:05:00
The county has seen as four fire districts. That's your fire administration, both Chavez Tome and Valencia Del Norte. 01:05:01
Earlier this year we did our pre ISO evaluation and in that evaluation. 01:05:09
A lot of things were noted, the biggest being a lack of staff. 01:05:14
The way that the the State fire Marshall and ISO currently look at our department. 01:05:20
Is basically as three. 01:05:25
Individually around departments within. 01:05:27
One department. 01:05:30
Therefore, every one of those three has to basically maintain its own ISO. 01:05:31
What that means is. 01:05:38
Staff from another district doesn't apply as staff to SO. 01:05:40
We'll take Valencia del Norte. 01:05:44
Any staff and that includes career or volunteer. 01:05:47
Those numbers don't count for Tomay or Los Chavez. 01:05:50
Like everywhere else in the country. 01:05:54
We've seen a a big decline in our volunteers. We do have career staff in two of our districts right now. 01:05:56
What this would allow us to do is basically say a member of Valencia County Fire Department counts as a member no matter where 01:06:03
they're at. 01:06:07
In that evaluation, it was brought to us that currently they could drop four of our fire stations to what they call an ISO Class 01:06:12

Which means that they would remove funding from those stations. 01:06:20
In essence, shutting them down. 01:06:23

I've had extensive talks with the State Fire Marshall with ISO. We didn't take this decision lightly. This is a a big decision for 01:06:28

But it's also a decision that's kind of happening statewide right now for the same reasons. 01:06:37
Allowing us to do this, we would dissolve the fire districts. The next resolution in front of you, you'll see, is going to be the 01:06:42
creation of one district. 01:06:46
What that means is all of our staff would then count for. 01:06:50
One district, our fleet could move freely. 01:06:54
Right now, if a truck breaks down in those Chavez, I can't pull a truck from town mayor Valencia del Norte to put it into service 01:06:58

This allows us to utilize our fleet. 01:07:09
Much more efficiently. 01:07:12
Utilize our staff much more efficiently and ultimately our budget by consolidating everything to just one. 01:07:13

The real likelihood is the ISO ratings in all the districts will decrease and that would definitely have an impact to Fire 01:08:47

And I am here today to share a timeline of events of some issues I have been currently having and still having. 00:05:28
With the Valencia County Sheriff's Department. 00:05:35
On June 26th at 2311 I contacted the non-emergency dispatch requesting an officer to my residence. 00:05:38
To file a report of assault and threats of bodily harm from a local farmer who had been drinking. 00:05:46
And assaulted me as I stood on my property behind my pipe fencing. 00:05:51
2318 dispatch called me back. 00:05:55
Patched through a call from Deputy Shane. 00:05:58
I told him what happened, explained on multiple times through the conversation that he had been drinking, assaulted me, threatened 00:06:01
me bodily harm and was still sitting on the ditch bank behind my home. 00:06:06
Zero response to my home. 00:06:12
On 6/25 I sent a message via Facebook Messenger to show Sheriff the hill with limited to no details, letting her know that I'd had 00:06:15
an issue. 00:06:19
With how they call was handled and I was instructed to call and ask for a Sergeant on duty. 00:06:24
And that I was welcome quote. 00:06:28
Well, UN quote. I was welcome to file a complaint and we can look into it for you. 00:06:31
625 I called non-emergency at 1314 and requested the Sergeant on duty Returned my call. 00:06:36
At 3:00. 00:06:43
And 6:25 at 1331 Sergeant Brown returned my phone call. 00:06:44
During my 19 minute, 8 second phone call, I was basically scolded being told that I would not have been assaulted had I not 00:06:49
engaged with the farmer verbally. 00:06:54
On 6/26 at 11:15, Lieutenant Espinoza called me unsolicited, maybe at the request of the Hill, I'm not sure. 00:07:00
To follow up with my message. 00:07:09
But he wanted me to wait another two days from there. 00:07:11
For Deputy Shane to come back on duty and have him deal with the situation that he should have already dealt with two days 00:07:14
previous when I called. 00:07:18
On 6/26 at approximately 12/30/13 hundred. 00:07:23
After denying that that was acceptable to Espinoza the day before. 00:07:28
He sent out officers Deputy Lyle and Deputy Baca, who responded to my residence. 00:07:32
Interviewed me, investigated, looked at what my claims were and also looked at a video and from that video determined. 00:07:38
That criminal. 00:07:46
Charges be filed against the individual that assaulted me. 00:07:47
But then on 6/29? 00:07:52
I turn in a typed formal complaint against Deputy Shane. 00:07:54
And Sergeant Brown not only to the Valencia County Admin Office across the street, but to the County Managers office down the hall 00:07:59

And checked on the status of my complaint, since I had still not heard from anyone in regards to my complaint whatsoever. 00:08:55

That both Denny Monette and then also Michelle Lachelle. 00:09:03
As a follow up had spoken to the Undersheriff. 00:09:08
Jeff Noah and is aware of my complaint and should expect to hear back from Noah soon. 00:09:11
On 8/18/23 at 1023. 00:09:17
I left a detailed voicemail for Noah and requested he call me back. 00:09:21
On 8/24/23 I had the hearing. 00:09:26
For the restraining order and was attempting to obtain. 00:09:29
Against the individual that assaulted me. 00:09:33
To my surprise, both Sergeant Brown and Deputy Shane showed up as a witness for the opposing party. Sergeant Brown condoned the 00:09:35
assault yet again from the witness. 00:09:39

By stating under oath that he had done the same thing, he would have done the same thing. 00:09:46
Assault is illegal. Is illegal. Is illegal. 00:09:51
Period. And to have Valencia County Sheriff's Sergeant condone the actions is despicable, to say the least. 00:09:55
On 8/28/23 at 9:17, I again called the county manager's office and spoke to. 00:10:02
Lachelle told her I would like a meeting with Danny Monette. I was told that. 00:10:08
Mr. Barnett schedules his own appointments and she would notify him of my request. 00:10:12
On 8/28/23 at 10:59 I received a phone call from Chief Deputy. 00:10:18

Full of attitude and obviously annoyed that he was the person who had the task of returning my phone call in regards to the 00:10:25
complaint filed at 6/29/23. 00:10:30
A day start of two months since the complaint had been filed, I was told that all of my complaints have been found. 00:10:35

On 8/28/23. 00:10:43
At 1134, I received a second phone call from deputy. 00:10:44
Perrone allowing that he. 00:10:49
Had missed some of the notes and a couple of the complaints have been found to be substantial. 00:10:52
And that the parties involved have been spoken to in regards to my complaint I asked for. 00:10:58
That in writing for the Valencia County Sheriff's Office website policy. 00:11:03
For formal complaints, Chief Deputy Tyrone said it was his fault the letter had not been sent out and would get one out sent out. 00:11:07
On 8/31/23 I received what I will refer to as a generic form letter signed by Sheriff Hill herself. 00:11:14

If you'll recall, back in the special session and the 3rd special session 2021. 00:12:55
The legislature appropriated. 00:13:01
$50 million for the construction of the hospital here in Valencia County. 00:13:03
Within several months of. 00:13:09
Then passing that, we negotiated a contract with DFA. 00:13:11
By which we would secure reimbursement for expenditures made. 00:13:15
Of those appropriated funds. 00:13:19
Shortly thereafter, in mid March of 2022, the county directed the preparation of a solicitation to identify provider, believing 00:13:21
that it would be more appropriate to have a provider on board who can help the county to. 00:13:28
Design and develop and implement a hospital that would meet the needs of the provider rather than one that the county thought it 00:13:35
might need. 00:13:39
So we issued the RFP in August 2022. 00:13:43

Received, I mean, we issued it back in March 2022. We received the responses in August 2022. 00:13:50
And since that time we've been negotiating with the provider, the, the healthcare facilities contract. 00:13:56
And pursuant to the Procurement Code, the contents of competitive seal proposals are not subject to disclosure during the. 00:14:03
A negotiation period, which is why it's still on executive session while we're continuing to discuss the negotiation of the 00:14:11
healthcare facilities contract and executive session. 00:14:15
But the work has continued and I want to share what what's gone on since then. 00:14:19

We identified a challenge you know and and working through the the the healthcare facilities contract with the provider that we 00:14:25
brought to our legislative delegation this past session. 00:14:29
In January and that resulted in both an extension of the time within which we had to expend the proceeds, the the, the, the 00:14:34
appropriation proceeds until 2026. 00:14:39
And also allowed for the use of 5% of the appropriated funds for pre opening expenses. 00:14:44
We're continuing to work through a couple of other obstacles. 00:14:50
Presently. 00:14:54
As it relates to the the actual design and construction of the hospital, of course we don't want to sit and wait to hammer out the 00:14:55
details of the healthcare facilities contract. 00:14:59
Or to to get started on the actual construction component of the hospital, because we do have a fixed time within which we can get 00:15:03
this constructed. 00:15:07
Accordingly, we issued phase one of the design build for the hospital. 00:15:12
And we've taken the input of and we've cooperated and coordinated with the hospital and their folks to to help to incorporate 00:15:17
their needs into that design build. 00:15:21
And this the county is shortlisted. 00:15:27

The architect is presently working on the phase two for the design build and we hope to have that on the street by the end of the 00:15:32
month and to have a contract awarded. 00:15:37
