If there's a. | 00:01:08 | |
Opposition to that, that I would appreciate that and if there's any other changes, my fellow Commissioners all accept those now. | 00:01:10
Any changes by staff? | 00:01:18

Thank you. | 00:02:18 | |
OK. | 00:02:40 | |
There's a couple of names on here that I can't read, but the first one I believe the last name is Smith. | 00:02:42
OK. | 00:02:48 | |
So hidden. | 00:02:49 | |
Step up and you'll if you'll just give your name and address for the record, please. | 00:02:51
Good evening. My name is Sharon Smith. | 00:03:01
I love that 7 Lewis St. | 00:03:04
And blind. | 00:03:06 | |
Which is Casa Colorado area, for those who don't know. | 00:03:08
I'm here again on the issue of the cannabis farm they're trying to put at the beginning of our neighborhood. | 00:03:12
I've spoke here before. | 00:03:19
We are very concerned. Our issues are still the same. We made sure you each had a copy of that last time we were here so you could | 00:03:21
see what our issues were. | 00:03:26
They have not changed at all. | 00:03:31
We have not heard from the county. I have made numerous calls. | 00:03:33
And I'm still not getting answers. | 00:03:37
I have tried to make an appointment to be at one of your hearings. | 00:03:40
So that we can talk to you. | 00:03:44
And nobody calls me back. | 00:03:48
So I made a second call and I used Mr. Sparkman. | 00:03:51
As my sponsor, because I didn't know how to be, how to get a hold of the sponsor, I didn't know who was the sponsor, who was in | 00:03:54
the sponsor. | 00:03:58 | |
And I was told no. | 00:04:02
No explanation. | 00:04:04
Just no. | 00:04:07 | |
I don't know if Mr. Sparkman said no or if they just. | 00:04:09
Don't use the Councilman. | 00:04:13
I would like to have a hearing. | 00:04:15
We have great concerns. | 00:04:18
And we are not being heard. | 00:04:21
And now this has gone on for quite a while. | 00:04:23
And we're still not getting answers. And I've spoken to Mike Milam. | 00:04:26
He probably remembers my call. And you did say you would call me as soon as anything changed. | 00:04:30
I haven't heard from my. | 00:04:37
I don't know if it's still on. | 00:04:38
I don't know if it's off. | 00:04:41
I don't know what my next step needs to be. I don't know if you have a requirement. | 00:04:42
For us to do something before we get to stand before you. | 00:04:47
Please advise us. | 00:04:51
We pay taxes. | 00:04:52 | |
We have been here 2022 1/2 years. Several of my neighbors have been here longer and some are little shorter than us. | 00:04:54
We should have rights. | 00:05:03
So please tell us how to get to your hearing so that we can express our concerns. | 00:05:06
And our complaints? | 00:05:11
And what are our issues are at this point? | 00:05:13
I've spoke to the road department. | 00:05:17
They will not call me back. | 00:05:19
I have given them questions. | 00:05:21
That there should be answers to. | 00:05:23
One lady said she's been there 20 years. | 00:05:25
Why can she not answer? | 00:05:28
Why that road is now called? | 00:05:30
Peace flamed, but it was not called Peace Lane when we moved here. But nobody seems to know that. | 00:05:33
Please answer our questions. Please help us with this cannabis issue. It does not belong in the neighborhood. You look around and | 00:05:41
there are thousands and thousands of acres of land. | 00:05:46
They're much more appropriate. | 00:05:52
For a cannabis farm, we are not telling you we don't think they should be out there. | 00:05:54
We are not putting in our political field. | 00:06:00
Thank you. Thank you. | 00:06:03
OK, I believe there is another signature like. | 00:06:07
OK. That's perfect. Go ahead and come on up if you'll just. | 00:06:12
You just state your name and address for the record, please. Evening, my name is Chuck Woodward. | 00:06:16
That was my wife you just listened to. | 00:06:20
7 Lewis St. there in Costa, Colorado. | 00:06:22
We've been in here before and I don't have a lot to say tonight. You know, I've said it all before. | 00:06:26
Basically here just to let you know that. | 00:06:31
We're we're still concerned. We're not going away. | 00:06:34
We're going to keep after this thing, you know, until we get something resolved. | 00:06:37
You know, like she said, there's a lot of various in that area. | 00:06:42
They're far more appropriate for something like this in a neighborhood. | 00:06:47
Everybody we've talked to says this is definitely going to affect our property values. | 00:06:51
We've got kids in the neighborhood. The Sheriff's Department has agreed that it's likely going to bring our crime rate back up | 00:06:57
again. | 00:07:01 | |
And we spent a long time and we. | 00:07:05
Organize a community. | 00:07:08
Watch. | 00:07:11 | |
System and we've cleaned it up and and we've got rid of there was a lot of crime there and this. | 00:07:12
Pretty much nonexistent now. We want to keep it that way. | 00:07:17
And so, like she said, we've been here over 20 years or 22 years. | 00:07:21
But there are people in that neighborhood. Been there 40 years and more. | 00:07:25
And I think that we should have a say in what goes on. | 00:07:29
What comes into our neighborhood? | 00:07:32
You know. | 00:07:34 | |
This is just not like. | 00:07:35
Somebody when this started, it looked like somebody who gets to build a house there. | 00:07:37
And it almost looked like they tried to sneak it in. You know, when they put the well in them, they put a big pile of dirt in | 00:07:42
front of it so you couldn't see it and. | 00:07:45
And you know, I I don't know. It's just it's just a screen deal. I I think that it's just not appropriate for a neighborhood like | 00:07:49
that. | 00:07:53 | |
To have. | 00:07:56 | |
That our neighborhood. | 00:07:57
I realize it's legal. I'm against it. | 00:07:59
Doesn't matter. It's legal, but we we just don't want it growing in our neighborhood. | 00:08:02
So that's it for me. Thank you. Thank you. | 00:08:07
OK, next we have a Ramon Baca. | 00:08:12
Good afternoon. | 00:08:26
Under one baca. | 00:08:27
A little bit 618 of drive. | 00:08:30
I've been in a long. | 00:08:32
Life residency born and raised. | 00:08:33
In the Conqueror. | 00:08:36
And I live in Berlin. | 00:08:38
But I was some different calculator I seen all that there was to be seen. | 00:08:40
I'd like to share with you yours have seen what? | 00:08:46
All these drugs have come up to how much is costing us all our taxpayer dollars. | 00:08:49
How much? | 00:08:55 | |
If. | 00:08:57 | |
It's hurting. | 00:08:58
No, there's nothing good. | 00:08:59
About this whole thing. | 00:09:01
And yet in Mexico, right now, it's got the 15th highest drug. | 00:09:02
In the United States. | 00:09:07
That New Mexico, but the whole United States. | 00:09:09
And that that's that's a shame to be that. | 00:09:13
To be categorized that high already. | 00:09:15
And and now we're, we're talking about that trying to add on. | 00:09:18
And giving them some more linkage. | 00:09:21
Another thing. | 00:09:24
I've seen in the. | 00:09:26
And a newspaper out of Socorro. | 00:09:29
Where the the. | 00:09:33
Attribute to Valencia County. | 00:09:35
$427,768. | 00:09:37 | |
I don't know if anyone you all were of it. | 00:09:42
Fairfield, address your comments to us please. | 00:09:46
If you want to leave that with us, that's fine, but when you're speaking, you speak to us and not the public. | 00:09:49
Thank you. Appreciate it. | 00:09:54
He's the facts that come up. | 00:09:57
Of all the five different counties, how much money was there was allocated for drugs? | 00:10:00
And. | 00:10:06 | |
To me. | 00:10:08 | |
Cannabis. | 00:10:11 | |
It's it's it's a drug. It's just like. | 00:10:12
Alcohol. | 00:10:15 | |
You may start with. | 00:10:16
Beer a day. | 00:10:17 | |
Week. | 00:10:20 | |
But eventually you you're gonna ease up and the same thing. You're gonna go with these drugs. You may smoke marijuana. | 00:10:21
Have a joint hearing now and then. | 00:10:29
But a leader? | 00:10:31 | |
Through all the other different. | 00:10:33
Stranger things. | 00:10:34
Another thing. | 00:10:36
Is a water. | 00:10:38 | |
Of all things. | 00:10:41
Your water. | 00:10:42 | |
Got. | 00:10:44 | |
If you had only seen. | 00:10:45
And I'm like the only hope to me. I'll remember what it was like in the in the mid 60s. | 00:10:48
When the rivers went dry. | 00:10:54
For the first time. | 00:10:57
We and the whole community, we didn't have the means and having deep well. We only had shallow wells. We had no water. | 00:10:58
Think about it, what you do go home today and not have no drinking water and you can rely on on your neighbor that might still | 00:11:06
have running water at that moment. | 00:11:11
And going on there and and pitching A5 gallon bucket of water. | 00:11:17
We are. | 00:11:23 | |
We were all in poverty. | 00:11:24
And we're still you must go. It's a poverty state. We're not. We're not no rich people. | 00:11:26
So and I ask. | 00:11:32 | |
Please consider taking those mean don't take those. | 00:11:34
Don't take those valuable resources from our children, our grandchildren, great grandchildren, is our precious water. Thank you | 00:11:38
very much. | 00:11:41 | |
Thank you. | 00:11:45 | |
OK, Next we had a. | 00:11:47
Simran Gonzalez. But I think you heard to speak on the zone change, Is that correct? | 00:11:49
You're you. Did you sign up to to speak? OK. You're you're wanting to speak on the zone change, so we'll do that when we get to | 00:11:54
that item, OK. | 00:11:57
That, that that'll be a different time for you to be able to address this. | 00:12:01
Michelle Shiplet. | 00:12:05
For Michael Shifflett. | 00:12:06
Michelle, I'm sorry. | 00:12:09
I'm here about the cannabis farm. | 00:12:16
If you'll just send your name and address for the record shiplett. | 00:12:18
I'm here about the cannabis farm in our neighborhood. | 00:12:22
I wonder if this forum was being. | 00:12:26
In your neighborhood, if they put it there in your neighborhood. | 00:12:29
Feet. | 00:12:32 | |
100, you know, 100 feet, 50 feet. | 00:12:34
From your homes. | 00:12:36
Would it disturb you or would it bother you? Is that? | 00:12:38
I mean, it's not so you're not worried about it. | 00:12:41
Mr. Sparkman, I voted for you. | 00:12:44
I expect something. | 00:12:46
Consideration. | 00:12:48
Something cordial. | 00:12:50
Just. | 00:12:52 | |
Yes, we're thinking about it. We do care about your neighborhood. | 00:12:53
We don't know why this stranger from. | 00:12:57
Corrales came down here, bought property, put in a six inch well. | 00:12:59
And it's. | 00:13:03 | |
We're going to let him grow pot in your neighborhood. | 00:13:04
I really hope that you guys will let us. | 00:13:09
Have a hearing, let us do something so that. | 00:13:12
We think or we believe that you're you actually do care what happens to us down there? | 00:13:15
And appreciate your time. Thank you. | 00:13:20
Thank you. | 00:13:23 | |
OK. I apologize, Dave Tate. | 00:13:49
OK. | 00:13:54 | |
Sarah take. | 00:13:56 | |
Ohh, that's. | 00:14:00 | |
OK, Sam. | 00:14:01 | |
That works for me if you just state your David. Just for the record. | 00:14:03
My name is Samantha Tate. I live at Tim Barbara Casa, Colorado. | 00:14:08
I am here again about the cannabis farm that is proposed to come into our neighborhood. | 00:14:13
And my I, am I allowed to ask you guys questions or can I only say this is not a question answer. OK. So you can go ahead and | 00:14:20
address this. OK And well will allow you to speak. All right. Thank you. | 00:14:27
Umm. | 00:14:34 | |
I don't know if you folks get together afterwards and talk about the issues that are brought up in front of you. | 00:14:35
So I don't know how anything gets resolved if you don't. | 00:14:42
Am I supposed to only speak to the representative? | 00:14:47
Of my area and. | 00:14:51
Am I even speaking to the right council here? | 00:14:54
I don't know because we don't get feedback. | 00:14:58
We get no feedback at all. | 00:15:02
For all I know, I'm just sitting here and you guys are thinking there's that crazy old lady from Casa Colorado again that doesn't | 00:15:04
want the canvas from. | 00:15:08
We're just trying to protect our neighborhood. | 00:15:12
And if I'm not speaking to the correct people? | 00:15:15
Please let somebody in our group know. | 00:15:18
So we don't have to come here and bug you guys. | 00:15:22
Every Wednesday that you have a meeting. | 00:15:25
Because if we don't get to the correct person, you're going to keep seeing our faces here over and over again until we get this | 00:15:28
resolved and find out who we can talk to. | 00:15:34
Thank you for your time. | 00:15:41
Thank you very much. | 00:15:42
And I just want you to all of you to know that they're speaking on the cannabis issue. You're not being ignored, but there are a | 00:15:44
lot of most of these restrictions are state or state. | 00:15:48
Rules that they have passed the ordinance and the legalization of cannabis. | 00:15:53
We have very little to do with it at county level, but I think that we'll. | 00:15:56
Danny, could you chime in a little bit on that? The individual has not brought a plan to the county asking for a cannabis. We did | 00:16:00
tell. I'm sorry, missus. | 00:16:05
Smith that we would get with him as soon as we heard something from this applicant. | 00:16:11
That's the reason they have not heard anything. I've spoke with their three times myself. | 00:16:16
And we have not heard anything back from the applicant since he came in three months ago. | 00:16:20
So it. | 00:16:24 | |
At the county level right now, nothing has come to us saying that he wants to do anything with the cannabis format, So as far as | 00:16:26
the county goes. | 00:16:30
He has not brought that to us and we have nothing saying that he's going to do that. | 00:16:35
Mrs. Hardeman was here, she has carried, she can answer any of those questions, she can pass them out to whoever wants, but. | 00:16:39
As far as the county goes. | 00:16:44
The applicant has not come to us and ask for anything. Mr. Chairman, if I could follow up on that. So Commissioner Sparkman's | 00:16:46
request and so that he wasn't later booted out of any zoning decision that might come before this board, he requested that staff | 00:16:52
and myself meet with the impacted individuals and visit with them about this project. | 00:16:58
And advise them to speak with the proper authorities regarding the licensure. | 00:17:36
Thank you very much. Nothing has changed since that, that you had that meeting with them. I've heard nothing. | 00:17:40
OK. Thank you. I apologize that you guys are having to deal with this, but. | 00:17:45
You know the the county is has very little face phone. What is happening with that? So thank you guys for your patience. | 00:17:49
But I'll give you a couple minutes if you want to come up again, Mr. Chairman. | 00:17:58
I'll advise that this board normally does not allow for rebuttals and so forth, but it's completely you're just it's completely | 00:18:02
your discretion how you'd like to approach. | 00:18:05
Please go ahead and come on up and we'll give you. | 00:18:10
Just a short, short time to speak, but the. | 00:18:12
Again, we're we're not going to, we're not going to get into any discussion other than what I've offered, ask you to get into | 00:18:15
this. Please go ahead and fax and address for the record Sharon Smith. | 00:18:19
7 Lewis St. | 00:18:24 | |
OK, Mr. Sparkman sat in the front lobby with us very first time we met. | 00:18:26
I had never met Mr. We're not, We're not going to go down that path. If you have something that you want to say this. | 00:18:32
He is the one that said we needed to get with the Commission and go to their hearing. | 00:18:38
I don't know if you recall that. | 00:18:43
But we did what he suggested and we're told no. | 00:18:45
Simple as that. | 00:18:50
We have tried to call people. | 00:18:51
People don't call back. | 00:18:54
We have been pulled. You make decisions and I know you do because we have another issue that from another neighborhood that you | 00:18:57
went to and talked to them right after the meeting. | 00:19:02
And we have not gotten the same kind of. | 00:19:08
Ability. | 00:19:11 | |
We. | 00:19:14 | |
Feel that you have ignored us. | 00:19:14
And you get paid. | 00:19:17
To be our commissioners. | 00:19:19
And yet, we can't get any of you. | 00:19:21
To speak to us. | 00:19:24
On a personal matter that will affect us gravely. | 00:19:26
On asking is give us the same chance you gave the people with the trucking issue. | 00:19:30
And let us talk to you, Let us know what you're thinking. | 00:19:35
Let us know if you come up with an idea we haven't thought about. | 00:19:39
And yes, we did speak to him. | 00:19:42
But we did not get any answers back from anybody. | 00:19:45
Well, you may not get the like I said, we're gonna end this right now. But I'm gonna tell you may not be getting the answers that | 00:19:49
you want, that you may not be getting answers because there may not be enough answers or answers for your questions. | 00:19:54
Mrs. Artemio will give you a card and if you wanted to discuss it with staff further, that would be fine. But we're going to end | 00:19:59
the public discussion at this time. We're going down the path that I don't want to go down that, OK? Can we continue to come to | 00:20:04
your meeting if you have 3 minutes every meeting you like to come. | 00:20:08
Thank you. | 00:20:13 | |
OK. | 00:20:16 | |
Move on to item number 5, our discussion non action items. Commissioners, is there anything we wish to bring to the table tonight? | 00:20:17
Mr. Chair I. | 00:20:25 | |
I think. | 00:20:27 | |
Mr. Davis is gonna talk on the. | 00:20:28
What our plans are for 4th of July. | 00:20:32
OK. | 00:20:35 | |
Yeah. Well, give me one second, we'll, I'll call you anything else from commissioners. | 00:20:36
Staff. | 00:20:41 | |
No, Mr. Chairman, that was Mr. Davis. OK, before we get Mr. Davis up here and thank you, I just want to say that. | 00:20:43
I attended the New Mexico. | 00:20:50
Counties State. | 00:20:52
Convention this weekend that was in San Juan County. | 00:20:55
First time ever I was able to attend that, and it was. | 00:20:58
Quite informative. They did a really good job. San Juan County and Farmington did a great job posting it. | 00:21:01
But during that time. | 00:21:07
Our own Jonathan Aragon ended his term as president of New Mexico Counties. | 00:21:09
And during. | 00:21:14 | |
The conference up there was apparent. | 00:21:16
As to how much support he had. | 00:21:18
From the members of New Mexico County, she's done an excellent job. | 00:21:21
And of course, as everything happens, you're all good. Things must come to an end. | 00:21:24
But I want to personally thank you for your efforts that you put forth. It was sure nice having you. | 00:21:28
As the commissioner from the Lindsey County, being president of Mexico counties and again you did a great job, so thank you. | 00:21:32
Mr. Davis, Courtiers. | 00:21:42
Mr. Chair, Commissioners was asked to come before you guys, reference to yet again fireworks for 2023. | 00:21:46
As you know, as of the 20th of this month there by state statute they are open for sale. | 00:21:53
As far as Valencia counting then incorporated areas we still. | 00:22:00
Our ordinance relies on what we call safe and sane fireworks. | 00:22:05
Safe and sane fireworks are the ones that are being sold if they say they emit sparks. Those are allowed in the unincorporated | 00:22:09
areas of Valencia County. | 00:22:13
Those fireworks are legally sold in the village of Los Lunas and Berlin. | 00:22:18
The other issue we have that we always have is with the Peralta area, of course they. | 00:22:24
Have no restrictions on their fireworks, they're they're allowed to sell the maximum that the state allows. | 00:22:30
Which causes us. | 00:22:35
A whole lot of issues here in Winston County, as you well know. | 00:22:37
But as of right now, they are being sold. | 00:22:40
Umm. | 00:22:43 | |
We're going to do the best that we can. It's almost impossible to. | 00:22:44
Get everything that the amount of fireworks that do come from Valencia County. | 00:22:49
And the staff that we have on hand, so we'll do the best we can. | 00:22:53
Enforcement. | 00:22:57
Is going to be hit and miss depending on what it is. | 00:22:58
If it causes property damage or somebody gets hurt, then we'll deal with it accordingly with that. | 00:23:01
So. | 00:23:06 | |
You still? | 00:23:08 | |
We'll try and get out on the ninth of the 4th of July and do some patrolling. | 00:23:09
But with the sheer volume that's going to come from down here, it's going to be almost impossible to. | 00:23:14
Please everything so. | 00:23:18
We ask and we'll get with the. | 00:23:21
The paper over here and try and get a couple of things in the next couple runs with some safety information. | 00:23:24
Go out to the residence, we'll try and get it on our website and stuff like that so people can see. | 00:23:29
They need to be safe. | 00:23:34
Making sure they have water available. | 00:23:36
Right ground. | 00:23:38
No grasses, that type of thing. | 00:23:39
The drought situation, of course we're not in the drought. | 00:23:42
According to the state, so. | 00:23:45
Even if we were, we're still a little bit behind the ball and making any further restrictions. | 00:23:48
That I've talked with Mr. Peter on the last couple of days reference to that. | 00:23:52
So that's kind of where we're at. If you guys have any questions or feel free to answer your answer as best as I can. | 00:23:57
For you. | 00:24:03 | |
Commissioners. | 00:24:04
Sure. | 00:24:05 | |
I don't want to over speak with Dave. | 00:24:06
What would I ask? | 00:24:08
Mr. Pato. | 00:24:10 | |
And the chief product if because we are on a time sensitive. | 00:24:11
To do restrictions. | 00:24:16
That they get. What is the date they've? | 00:24:18
It is. | 00:24:22 | |
Still the cell. | 00:24:25
So what? | 00:24:30 | |
Go ahead, Good Dave. | 00:24:32
On this calendar and they share with us that. | 00:24:41
As we get towards that time so we don't miss. | 00:24:45
And if I can add a chief properties also on zoom if anybody would like to speak with him also but he has agreed to do that. | 00:24:49
Chairman Fishers. | 00:24:57
Dave Pado, I think your mic is off. | 00:24:59
Ohh, I apologize. There it is. Thank you, Tessa. | 00:25:02
Anything else? | 00:25:08
Mr. Chairman. | 00:25:09
I just want to reiterate what? | 00:25:11
Mr. Davis said. | 00:25:14
You know the the calls that are going to be coming in are going to be. | 00:25:16
Uh. | 00:25:20 | |
Very, very high in volume and I know I got. | 00:25:21
Multiple emails. | 00:25:25
Days before the day of and. | 00:25:28
And. | 00:25:30 | |
Actually, I think even a couple. | 00:25:31
Weeks after. | 00:25:33 | |
4th of July that. | 00:25:35
We need to enforce this deal. | 00:25:37
We are. I think we're going to be enforcing the most severe cases. | 00:25:39
Where people were putting stuff in in. | 00:25:43
People in danger? | 00:25:45
You know, I I know that the Sheriff's Office is going to. | 00:25:48
Do their due diligence and follow up on any. | 00:25:52
Probably yet, but. | 00:25:55
Just. | 00:25:57 | |
Do the sheer volume it's going to be difficult also responding to? | 00:25:58
Emergencies as far as? | 00:26:02
For our students. | 00:26:04
Anything else that may happen, so Please be patient. | 00:26:06
Umm. | 00:26:09 | |
Please continue that e-mail and. | 00:26:10
And follow up with us and we'll get with you as soon as possible about it. | 00:26:13
But it's it's just one of those things. One day that's. | 00:26:17
Crazier, but likes to let loose and and it's hard to. | 00:26:21
Really be on top of it with. | 00:26:25
Many, many cases that may pop up. | 00:26:27
Thank you. | 00:26:31 | |
Issues. Anything else? | 00:26:32
This has been such a hard issue for us over the years and. | 00:26:35
And which we can do about it in our backyard. So it's it is what it is. So we appreciate everything that you guys do and. | 00:26:38
And we do the rest to keep the community safe and you guys keep yourself safe and. | 00:26:44
Do the best you can. We know we will. We know that you will. | 00:26:48
Appreciate that. Thank you. So you may have any questions for Chief Profile. He's with us, Andrew. | 00:26:51
Appears not. | 00:26:57 | |
Chief, thank you for being with us on Zoom, but it looks like you're off the hook for questions tonight. | 00:26:58
Thank you, Chairman. | 00:27:04
OK. Anything else under the discussion on action? No, Mr. Chairman. | 00:27:08
Very good. | 00:27:12 | |
OK. We're going to go ahead and move into item number six, our public hearing items. We've got three of them. We've got two zone | 00:27:14
changes on the agenda tonight. The first one is going to be. | 00:27:18
On the property on 11 Columbus Rd. Los Lunas. The second one is going to be on 52 La La La Veta Rd. in Bolen. | 00:27:23
So the first one again is zone change #2023-002. | 00:27:31
And if there's anybody that's going to speak to the Zone change in Los Lunas, if you would please stand and be sworn in at this | 00:27:36
time. | 00:27:38 | |
You can just stand at your seat to be sworn in. | 00:27:43
Do you swear or affirm that those socially that you were given this case will be the truth, the whole truth, and nothing but the | 00:27:48
truth under the penalty of the law, so help you God? | 00:27:52
OK, Mr. Buck, that's all yours. | 00:27:58
Chairman, Commissioners, good evening. | 00:28:04

This was heard by the PNC Commission on April 25th and it was recommended for approval at that time. There were a few people from | 00:29:01
the public both for and against this at that time. | 00:29:06
There was a little bit of opposition, a little bit of. | 00:29:12
Stuff for it that approved it. | 00:29:14
Very good. | 00:29:16 | |
And they stand for any questions, any questions, Mr. Buck at this time? | 00:29:17
OK. Thank you. Thank you so. | 00:29:22
Anybody that's going to speak on this, give testimony, please stand up and state your name and address for the record and also if | 00:29:25
you'll let us know. | 00:29:28

I'm I'm, it's my mom that I'm her daughter, Angela. | 00:29:33
Good. Just state your name and address for the record. Thank you. OK and little Madam. | 00:29:38
OK. | 00:29:43 | |
I'm here today on behalf of my mom. | 00:29:45
Umm. | 00:29:48 | |
My mom had a total knee replacement, so that's why she can't be here today. | 00:29:49
She's in a lot of pain. | 00:29:53
Umm. | 00:29:55 | |
I live. | 00:29:58 | |
On my mom, she lives on the West Side. Well, I live on the West Side. | 00:29:59
Getting to her house. | 00:30:05
Takes time especially. | 00:30:07
Traffic is moving, the traffic is heavy. | 00:30:10
My dad and my brother. | 00:30:15
Have passed away. | 00:30:17
So she has no one else but me to care for her. | 00:30:22
My parents have owned this land for 55 years. | 00:30:26
Before my dad passed away. | 00:30:31
He told my brother. | 00:30:33
That he was to build a house on the land. | 00:30:36
So he could be there to take care of. | 00:30:40
My mom. | 00:30:44 | |
Back then, a second home. | 00:30:46
Of land was allowed. | 00:30:49
After my dad passed away. | 00:30:54
My brother asked for permission to build. | 00:30:56
Only to be told rules had changed. | 00:31:00
We were never made aware. | 00:31:07
That zoning had changed. | 00:31:11
And my dad's. | 00:31:14 | |
Wishes were denied. | 00:31:15
I now lost my brother. | 00:31:20
I have a family. | 00:31:23
Husband. | 00:31:25 | |
And children. | 00:31:26
Traveling back and forth is difficult. | 00:31:28
Because of her health issues. | 00:31:32
I need to live near my mom. | 00:31:35
To care for her without her losing her independence. | 00:31:38
Please take my petition into consideration. | 00:31:43
So that we can build our house near my mom. | 00:31:47
Thank you. | 00:31:51 | |
Thank you. | 00:31:52 | |
Any questions? Any questions? Applicants, I guess representative, I guess is what we would refer to as at this point, | 00:31:56
Commissioners. | 00:31:59
OK. | 00:32:04 | |
Thank you. Is there anybody else that wants to speak on behalf of this zone change? | 00:32:05
There's there's not Mr. Baca. | 00:32:13
You have a map of the area. | 00:32:15
Would you please bring that up? | 00:32:17
OK. | 00:32:48 | |
Is there any R1 in that area? | 00:32:51
Yeah, please come up. Thank you. | 00:32:55
Chairman Commissioners are when I guess would be a better question, yes. So their closest R1 zoning is to the east. | 00:32:58
Approximately 0.2 miles. | 00:33:06
So we can see the highlighted here and the closest R1 is the purple district off to the east from there. | 00:33:09
I can pull that up on the other map to show it a little differently. | 00:33:21
Closest R1 is directly E approximately 0.21 miles. | 00:33:55
Very good. | 00:34:06 | |
Commissioners, any other questions? | 00:34:07
Under your review, did this meet the criteria for? | 00:34:12
The zone change. | 00:34:15
Yes, it did, Sir. | 00:34:17
Anything else, Commissioners? | 00:34:21
OK. There being none, we will be making a decision on this a little bit later in our meeting after our executive session, OK. | 00:34:25
OK. | 00:34:31 | |
We'll move on to our next zone change item number seven. This is one at the address of 52, La La La La La Theta Rd. Belen, NM. | 00:34:33
This is zone change number. | 00:34:40
2023-021. | 00:34:42 | |
To buck again. | 00:34:45
I'm sorry, before you start, if there's anybody here that's gonna speak in or give testimony on this one change, I would ask that | 00:34:48
you please stand to be sworn in. Please, I apologize. | 00:34:51
Do you swear or affirm that the testimony that you were given this case will be the truth, the whole truth, and nothing but the | 00:35:00
truth and the penalty of the law? | 00:35:03
To help you guys. | 00:35:07
Thank you. | 00:35:09 | |
Now, Mr. Bucket, Mr. Mr. Mr. Buckley, could you for the matter of. | 00:35:10
Recording Would you mind getting out of the map screen? | 00:35:15
Thank you. Sorry about that. | 00:35:27
Thank you. Sorry about that. Chairman, Commissioners, good evening. | 00:35:28
Before you this evening is another zone change, a request for another zone change. This is number 2023021. | 00:35:31
This is in District 4, PNC Commissioner sublet. | 00:35:38
Board of County Commissioners Bissell. | 00:35:42
Assess Cipriano Ramirez request a zone change from rural residential two district R2 to rural residential one district R1. | 00:35:44
To split the property into two lots. | 00:35:53
Legal Description Subdivision land of Toby and Lydia Pino. | 00:35:55
Track C1B. | 00:35:59 | |
2.08 acres. | 00:36:01 | |
C 4/24/2000 revision. | 00:36:03
Located at 52 Ladera Rd. | 00:36:06
Berlin, New Mexico 87002. | 00:36:09
UPC 1006033. | 00:36:12 | |
475. | 00:36:16 | |
335 followed by 6 zeros. | 00:36:18
Currently zoned rural residential two District R2. | 00:36:21
This was also heard on April the 25th at the PNZ Commission. | 00:36:25
In front of the ANC Commission and they did recommend this one for denial at that time. | 00:36:29
There was also some opposition at the time of that meeting as well for this case, which I think. | 00:36:33
Some of those individuals are here tonight as well. | 00:36:38
OK. | 00:36:40 | |
And they stand for. Any questions, Mr. Bucket, this time? | 00:36:40
OK, there's one right now. Thank you. Are the applicants here in the audience? | 00:36:45
Yes, OK. | 00:36:49 | |
If you. | 00:36:50 | |
Would like to come up together individually however you would like to do with this. | 00:36:51
They both your names. | 00:36:55
For the record in your address please. | 00:36:56
Hello, my name is Boise Ramirez. This is my father, Jose Sipriano Ramirez, who's the applicant? I'm here to speak on his behalf. | 00:36:59
Thank you. | 00:37:06 | |
Language barrier he doesn't understand but. | 00:37:08
We want to have a clear communication. | 00:37:10
So we did stand here in April and requested to get that zone change. | 00:37:13
My father's requesting to split his acre and two acres .1. | 00:37:21
Into two lots. | 00:37:26
Umm. | 00:37:27 | |
At that time, we did mention our reasonings behind where. | 00:37:29
We would like to move to the. | 00:37:33
Property but. | 00:37:35
Would like to sell the other part or. | 00:37:36
You know if that doesn't work. | 00:37:39
Be able to hand it down to. | 00:37:41
One of his children or grandchildren. I mean, whatever. | 00:37:43
You know, it's decided. | 00:37:47
I mean, we don't know what will come, but. | 00:37:49
You know at that time I did mention to. | 00:37:53
I mean, I mentioned to the people here that. | 00:37:58
You know, we did do our research and noticed that. | 00:38:01
A lot of the properties in the surrounding area are an acre. | 00:38:05
In size, they're already with the construction. | 00:38:09
We have a vacant land. | 00:38:13
And, you know, we thought that that was a good. | 00:38:15
You know reason to request. | 00:38:18
You know the the the change. | 00:38:21
At that time we had a. | 00:38:25
Several of the neighbors. | 00:38:27
You know, post to it and we didn't feel that it was. | 00:38:29
You know, for reasons that. | 00:38:32
Are really? | 00:38:35 | |
Related to zone change or I mean I I understand their concerns obviously that's that's important. | 00:38:36
But for example, one of the neighbors mentioned. | 00:38:42
That. | 00:38:45 | |
He was concerned about value if a mobile home, 2 mobile homes were going to be brought in instead of 1. | 00:38:46
And I think that. | 00:38:53
That. | 00:38:54 | |
Reasons. | 00:38:55 | |
A little bit out of everybody's control, people continue to bring in mobile homes in the area. | 00:38:56
Another. | 00:39:02 | |
Neighbor brought up his concerns to be that. | 00:39:03
You know what if another mobile home? | 00:39:07
You know, gets put in and. | 00:39:09
He was concerned about. | 00:39:12
A crime in the area. | 00:39:13
So again, another thing that we did in Phil was really. | 00:39:15
A good reason to conclude our to make a decision based on. | 00:39:18
One of the neighbors did bring up that. | 00:39:23
Because they are behind our property and there are water rights in our property currently. | 00:39:26
That. | 00:39:33 | |
They want in the future. | 00:39:33
To have the opportunity to apply for water rights and obtain water rights. | 00:39:35
From that ditch. | 00:39:39
I believe they're paying for for the those water rights, but they don't have them. | 00:39:41
I don't. I don't know how that's. | 00:39:45
Being worked but. | 00:39:47
I think that. | 00:39:49 | |
I mean if. | 00:39:51 | |
That is. | 00:39:52 | |
Something a little bit outside of the scope for why we're requesting the zone change and. | 00:39:53
You know what we we want to know. | 00:39:59
Why, if a decision is made? | 00:40:01
You know why those comments are being taken into consideration? | 00:40:04
Versus what you look at? | 00:40:08
You know, overall what's the big picture that you look at to consider a zone change and. | 00:40:10
You know, that's that's what our request is. That's why we're here today. | 00:40:16
Anything else? | 00:40:21
Any questions, Commissioner? | 00:40:25
Any questions of the applicant chair please? | 00:40:28
So you really don't have any. | 00:40:30
He said you might give it away, you might sell it. | 00:40:34
So you have no real plans for it, right? | 00:40:36
At this time, my father has been owner of the property for 15 years and he currently grows trees on the property. | 00:40:38
And he drives there daily. | 00:40:46
I mean, he loves the land. He wants to move in. | 00:40:48
Umm. | 00:40:51 | |
But it's it's a huge 2 acres that's big for two people that are already. | 00:40:52
Getting up in age. | 00:40:57
And. | 00:40:58 | |
You know, what would you do as a property owner? I mean, are you going to hold on to the land? Try to maybe? | 00:40:59
Sell it and get money back so that you can have a. | 00:41:05
And good retirement, you know you're. | 00:41:08
And enjoy your retirement, which you've worked so hard for. I mean, this was. | 00:41:10
A property that he initially purchased as an investment. Then he was like, oh, I like the property I want to move. | 00:41:13
Umm. | 00:41:19 | |
And. | 00:41:20 | |
Again, I mean we we want to sell just to give them the opportunity to have a a better retirement, but. | 00:41:21
Again, that's another thing that's a little bit. | 00:41:28
Out of our hands. | 00:41:30
Whether it will sell or not, we just don't feel that it. | 00:41:31
Should be a determining factor for. | 00:41:35
The zone changes decision whether. | 00:41:37
The reason he's asking is to sell or not. | 00:41:40
I mean, is it allowed to? | 00:41:43
Split. | 00:41:44 | |
That's. | 00:41:45 | |
That's where we want. | 00:41:46
We we we feel that that the focus is more on. | 00:41:48
Why do you all allow the zone change? Is it because of personal reasons? Because. | 00:41:51
You know, like our the previous story, because there's a. | 00:41:56
A story behind why the person wanted to split or is it? | 00:41:59
I mean, is it just? | 00:42:03
Why like? | 00:42:04 | |
Sure, And are we allowed to? | 00:42:05
I mean, is this sufficient or request doesn't meet the criteria? Does it mean what you're looking at overall? | 00:42:08
That's. | 00:42:16 | |
I feel special. | 00:42:19
Commissioners, anything else? | 00:42:20
Dave, this might be a good time to address the criteria. That's. | 00:42:22
That we will be considering for the zone change, if you would please. Absolutely, Mr. Chairman, happy to. So when we look at any | 00:42:26
zone change, this Board examines. | 00:42:30
Number one, whether it's consistent with surrounding land uses, and this might be a good time to. | 00:42:34
Ask that we put the map, and the board generally does that and looks to see whether or not there are other R ones. | 00:42:39
And what how far they are and whether or not that's the trend in the area? | 00:42:44
So if. | 00:42:48 | |
P&Z might be able to pull that up. | 00:42:49
Mr. Buckley would come up to So We Get the get You on the recording. | 00:43:37
Chairman, Commissioners, the nearest. | 00:43:42
R1 zoning for this property will be approximately 1.2 miles. | 00:43:45
For the north and also. | 00:43:50
Just slightly more than that, 1.28 approximately southeast from there. | 00:43:53
There are similar size properties and similar uses of the properties, but the nearest R1 zoning is at least 1.2 miles. | 00:43:57
Thank you. | 00:44:09 | |
Mr. Chairman, the the next consideration this board takes into account and considering whether or not to grant a zone change | 00:44:12
request. | 00:44:15 | |
Is whether or not it advances the goals stated in the Comprehensive Plan. | 00:44:18
That's a very broad a broad. | 00:44:22
Criteria. | 00:44:27 | |
And our comprehensive plan is is very broad and covers many different sorts of. | 00:44:28
Uses density and so forth. | 00:44:32
And finally, this board examines whether or not the change would be would that would advance the health, safety and welfare of | 00:44:35
county residents. So we look at. | 00:44:39
In access to services and access to utilities and access to to Fire Protection and so forth, and whether or not this would unduly | 00:44:44
burden the area or whether it would otherwise advance the health, safety and welfare of. | 00:44:51
Of the. | 00:44:58 | |
Community. | 00:44:59 | |
Very good. Thank you. | 00:45:01
I hope that answers your question. | 00:45:02
That you post us. OK, I know we had some people here that also wanted to speak so. | 00:45:04
Who wants to come up first? If you'll just state your name and your address for the record. | 00:45:08
And are you going to speak on your behalf or is it the gentleman that's on on the zoom level? | 00:45:12
Yeah, that's my question. First of all, speak up on my half. | 00:45:17
The gentleman Zoom says that he's been trying to get through and keeps dropping. | 00:45:19
OK. So let's go ahead and take your testimony. If you'll just state your name and address for the record. So and I want to know if | 00:45:23
I could give maybe 3 something the phone and maybe she could text me. That's not technically possible for her to call and have him | 00:45:28
testify over Zoom. He asked to actually call in. OK well he he basically called him on the phone saying he can't connect. He's in | 00:45:33
Los Alamos, got a new job. | 00:45:38
Is going through training and this and that and you can't. | 00:45:44
And down because of the new job? Sure, so. | 00:45:46
That's that's why I tried. | 00:45:50
OK, well, let's go ahead and take your testimony at this time. Let me give my part then. If they let you talk, I'll let, I'll let | 00:45:52
them talk to you. | 00:45:54
OK, first of all, so let's let's get started. | 00:45:58
We're going to take your test name, Simran Gonzalez again, your name, address and mine Ladera. | 00:46:01
Did you receive a certified letter as notice of this object? Yes. OK, Mr. Chairman, if you could also request you identify whether | 00:46:06
or not he was also sworn in for. | 00:46:10
Yes, we're just learning this morning. Thank you so much. I appreciate it. | 00:46:14
So. | 00:46:18 | |
I live just due South. | 00:46:20
Of the land and on the South side of them we share the same irrigation ditch. | 00:46:22
Like I said, Ohh. | 00:46:29
This might have caused conflict between my neighbor. We've always got along. | 00:46:31
Might not get along with you now. I have nothing against them. | 00:46:36
But. | 00:46:39 | |
And I've said before, I didn't want it zoned because when we bought that area, the guy that split that area up, he split up into | 00:46:40
two acre lots. | 00:46:43
Because back when he stood up, he could have went one acre lot and sold him one acre piece of. | 00:46:47
But he didn't want it to be that that small, so it's went to today across sections. | 00:46:52
It's been in A2 acre section zone. | 00:46:57
And everybody that's kind of moved there knew that when they bought it, so. | 00:46:59
For us to live there and be like, ohh **** and everybody's going to start setting it up. | 00:47:03
Nobody in the zoned area or nobody in the immediate area that bought that. | 00:47:07
I think it was like 8 acres or 8.9 acres. | 00:47:11
Nobody. | 00:47:14 | |
Everybody bought it with the assumption it's a two acre lots in the section area. | 00:47:16
So now he's trying to split his two acres. So now we have two people. | 00:47:21
And then individual Gabes named Gabe Ortega. He has his role, so he supplies the. | 00:47:25
Access. | 00:47:31 | |
To the bottom 2 acres, which is. | 00:47:32
Find. | 00:47:34 | |
Get split up. | 00:47:35 | |
Though he disagrees, he don't want more people going down because access roads that already go down the Access Rd. | 00:47:36
So. | 00:47:43 | |
I don't want just more people living there because now we already have it. I have some space I have. | 00:47:45
I mean closest neighbor to me is at least. | 00:47:50
2 acres. | 00:47:53 | |
Away from me. | 00:47:54 | |
I like it that way. | 00:47:56
I don't have a lot of like. | 00:47:58
Robots. I don't have this. I don't. | 00:48:00
I'm not. I don't know. I can't predict the future. Somebody even there might move in their grades and they might not. | 00:48:01
Ohh. He's been trying to sell the two acres a while back. | 00:48:08
I don't know if he's still trying to sell it. I've never talked to him, never asked him. | 00:48:12
I don't know if he thinks that he splits it up. He sell one acre lots easier than two acre lots. | 00:48:15
Like I said, I don't know what his finance he says planning to move there. That's fine, he's. | 00:48:20
Ohh. He's planning to have his grandchildren take over, his family take over. They could take over 2 acre lot I I. | 00:48:26
Have no no rights with his family moving in. | 00:48:33
I mean. | 00:48:37 | |
You're all welcome. | 00:48:38
As far as that goes. | 00:48:40
And I guess at that point that's probably all I kind of want to say, I just. | 00:48:42
Trying to keep. | 00:48:45
Our two acre areas and two acre areas. | 00:48:46
Anything. | 00:48:49 | |
South of us is like. | 00:48:50
Makers, 5 acres, 5 acres. | 00:48:52
It's it's all like pretty much bigger lots till you get to that distance, he's maybe saying. | 00:48:55
Where they break it down against maybe one acre sections but. | 00:49:00
For the most of it, that's zoned 2 acre area. | 00:49:04
We'd like to try and keep it that way if we could. | 00:49:09
Thank you that that's it. So I need to try and get with Jesus so she can try and connect to him or can I just? | 00:49:14
Get him on the line. Tester, did you have a comment? | 00:49:19
Yeah, there's nobody been nobody in the waiting room or anybody that has tried to connect, because then it notifies me and then I | 00:49:23
allow them in, but nobody is connected at all. | 00:49:27
OK. | 00:49:32 | |
Gabe, they're saying you haven't tried to connect? | 00:49:33
Step outside in their lobby teeth. Speak with him. | 00:49:37
OK, we had some other people that wanted to. | 00:49:43
We call her out down here. Yes, Sir. Could you come down to the lobby, please? | 00:49:48
Thank you, Ray. | 00:49:52
OK. | 00:49:54 | |
I'm sorry about that. If you'll just state your name and address for the record and whether you were sworn in, I believe also | 00:49:55
correct, it was OK. And also, did you receive legal notice of this one change? Yeah, OK. | 00:50:00
Marjorie McConnell at 7 Lane Order circle. | 00:50:06
Umm. | 00:50:09 | |
My property is next to. | 00:50:10
Mr. Ramirez. | 00:50:14 | |
Property, and I'd like to give you a little history about that. | 00:50:15
Little neighborhood. I've been there since 1997. | 00:50:19
Originally the owner of the property, there's our property Now my ex-husband and I come on it. | 00:50:22
Umm. | 00:50:29 | |
Wanted to turn. | 00:50:30
Our Peace and Dave and Dory Sanders, who are 15. | 00:50:32
Lane or circle? | 00:50:36
Into one acre pieces. | 00:50:37
And put in a couple of shared wells and. | 00:50:40
Rent out this property or sell. Sell when they're property. | 00:50:43
For. | 00:50:47 | |
Little Mobile Home Park. | 00:50:48
He thought that would be a great opportunity to to develop it. | 00:50:49
And I don't this is like 1999 two thousand, because we bought the property in 2001. | 00:50:52
And I don't know if he went through a formal process to see if he could subdivide his 11 acres into one acre pieces. | 00:50:59
Or if the county just got wind of it. | 00:51:07
But he was turned down. | 00:51:09
He was told no. | 00:51:11
So there's already precedent. | 00:51:13
In in on our property. | 00:51:15
That the subdivision into one acre pieces. | 00:51:18
Has been disapproved. | 00:51:21
And I don't know. Like I said, I don't know if it was a formal process or not, but Mr. Baca just. | 00:51:23
At that point, he threw up his hands. He said, OK, I'm going to. | 00:51:29
Resurvey this into 52 acre pieces. 2 plus acre pieces. | 00:51:33
And I'm just gonna sell these pieces. Well, my ex-husband and I bought three of those pieces, and they've and Dory Sanders, who | 00:51:37
aren't here tonight, they gave testimony last time. | 00:51:41
Um, but the other two pieces? | 00:51:46
So. | 00:51:49 | |
It seems to me that there's already. | 00:51:50
An idea that. | 00:51:55 | |
Subdividing into one acre pieces in that neighborhood. | 00:51:58
Is already something that was. | 00:52:02
That was not allowed and is not the intention of the of the. | 00:52:04
County. | 00:52:08 | |
In the long term, planning to have. | 00:52:09
To rural residential to. | 00:52:11
Pieces to to keep the flavor of the rural community up. | 00:52:13
And so, you know, that's, you know, I'm the one with the water. | 00:52:18
With the water rights thing, umm, we we've been paying the Rio Grande. | 00:52:21
Conservancy District. | 00:52:26
The taxes to have access to the water and sewer on and I can probably. | 00:52:28
Work out some access, but it was a concern of mine. | 00:52:32
That if I want to develop that property into some sort of agricultural property, you know, hang on to it, or if a future buyer | 00:52:35
wanted to. | 00:52:40 | |
Develop that property into something agricultural or horse property or whatever they would need that water. | 00:52:44
And it was a concern of mine that. | 00:52:51
Subdividing this little. | 00:52:53
There, there are two. There are two acre piece into. | 00:52:55
Into. | 00:52:57 | |
To one acre pieces was going to. | 00:52:59
Make that access a little more difficult. | 00:53:02
And. | 00:53:05 | |
Not as amenable to the two acre. | 00:53:08
Flavor. | 00:53:11 | |
That the county wants to maintain. | 00:53:12
So you know, there's also the the idea that you know there's access. | 00:53:15
To get into that one acre that they want to just keep, you know, they want that they want to subdivide and not. | 00:53:19
And and not develop but. | 00:53:25
I, you know, I just. | 00:53:28
Cimarron was right, we have. | 00:53:30
We bought those properties because we wanted the space. | 00:53:32
And we want to keep that space. | 00:53:36
So I want to thank you for your consideration and. | 00:53:38
I hope my little history lesson has given you some. | 00:53:41
Information to think about while you go back into session. | 00:53:45
Thank you. | 00:53:48 | |
Any questions? | 00:53:49
Thank you very much. | 00:53:55
Mr. Chairman, if you have a minute. | 00:53:56
I do. | 00:53:58 | |
Apologize for that. We had some other people that I believe were sporting wanted to speak. | 00:54:24
Is there anybody else want to speak on this zone change? | 00:54:29
Anybody else in the audience that wants to speak on this one change? | 00:54:33
Ma'am, I tell you, representing your father. | 00:54:37
Did you want to come forth and address some of the concerns that were brought forth? | 00:54:40
Please go ahead. I mean, I just want to just. | 00:54:53
To say what I. | 00:54:57 | |
Restate what I mentioned earlier. I'm not hearing anything. I mean, I understand their concerns. I I think that they're valuable. | 00:54:59
Of course, we're all. | 00:55:05
Property owners we have. | 00:55:06
You know intentions with our land and we we follow rules and. | 00:55:08
You know, we we. | 00:55:12
We want to work things out and. | 00:55:14
You know, all that good stuff. | 00:55:16
But. | 00:55:18 | |
Again, I'm not hearing anything that. | 00:55:19
That is really like, I mean he explained earlier what you look at for zone change and. | 00:55:22
I mean I know there is a distance of 1.2 with the most. | 00:55:28
You know, close R1. | 00:55:33
But again, I I ask that you look at the surroundings. There are smaller lots and. | 00:55:36
I mean their concerns are mobile homes. It's something that's going to continue. We're not making a huge impact difference with. | 00:55:41
With value with. | 00:55:47
You know, if we were to accomplish that in the future, again, we were all just assuming what's going to happen next. | 00:55:48
You know, we do have the intent to sell or to pass down. We we don't know. And yes, we we did try selling the property at 2 acres. | 00:55:54
This was about two years ago. | 00:56:02
My father had a stroke heart attack and I mean again, he goes daily works on the land. It was something that we needed him to stop | 00:56:04
doing so that he can recover. | 00:56:08
His back working, his back going daily. | 00:56:13
I mean the neighbor to the back that has a concern with the water irrigation rights. | 00:56:16
It's a vacant land. I don't even think that the the owner goes there regularly. I don't know. I'm sorry if I'm assuming. | 00:56:20
But it's a vacant land full of weeds. | 00:56:26
I mean. | 00:56:29 | |
She's concerned about the value of her property. She's concerned about. | 00:56:30
You know, someone buying in the future and what they're going to do. But then she's also neglecting our needs and what we want to | 00:56:34
do as current homeowners with. | 00:56:37
You know current. | 00:56:42
Physicians that we want to make now. | 00:56:44
I feel that that's a little bit of selfish. | 00:56:46
On that. | 00:56:48 | |
Comments personally. | 00:56:49
But again, I'm not taking away anyone's, you know, rights or comments or I mean. | 00:56:52
Everybody has their own opinion. | 00:56:58
We just asked that you. | 00:57:00
You know when you look and review my father's case that you. | 00:57:02
You know, look at the big picture on what does this area look like. Look at the property sizes of. | 00:57:06
And consider that. | 00:57:12
As a decision. | 00:57:14
You know as a factor in your decision making. | 00:57:16
There are those two acre lots that. | 00:57:19
The owner. | 00:57:22 | |
So my father's right mentioned. | 00:57:25
But it's only a section of four. You'll see in the map it's only a section of four acres. The rest, it's really spotty in that | 00:57:27
area. I mean, you see, you see some beautiful custom homes. | 00:57:32
And five acre. | 00:57:37
Blots and you see some that are just in. | 00:57:39
You know, .75 of an acre mobile homes, it's it's really spotty and. | 00:57:41
I don't think it impacts value of homes. | 00:57:46
Honestly, it's. | 00:57:49
I mean. | 00:57:51 | |

No. | 00:59:36 | |
You wish you had an interpreter. Let me just kind of add a comment to there so that it's clear what my father's trying to say. I | 00:59:40
mean, I think that there's a lot of, you know, emotions of, you know, everybody's concerned with what might happen. | 00:59:47
They they have their ideas, We have our ideas. And he just brought something up that might not be within your scope. You just | 00:59:55
wanted to. | 00:59:59 | |
Mentioned that in. | 01:00:03
Currently they they there is a water rights that they share him and one of the of the neighbors that are here. | 01:00:04
To come in and you know he's not allowing access to the easement and you know, again it's it's something that might be out of the | 01:00:12
school but. | 01:00:16 | |
Because he he felt it was important to mention that, you know, to show that, I guess maybe that the. | 01:00:20
The neighbor can also cooperate and via a good neighbor in that sense I I I believe that's what where he was trying to get with | 01:00:27
this. Thank you. | 01:00:31
Because not setting my alarm. | 01:00:37
He was. He was interested in buying the land before it was first till five years ago. | 01:00:41
Ohh yeah my love. | 01:00:49
Your lunch for me? | 01:00:51
She is ending. | 01:00:54
OK. Thank you so much. Thank you. | 01:00:55
Sir, I know that you were trying to get your. | 01:00:57
Another neighbor on the on the phone. | 01:01:00
Please go ahead and come on up so we can. | 01:01:02
Explain to you what the what the situation is. | 01:01:05
Unfortunately, we can't take any testimony over the phone. | 01:01:11
We would have to have them either here in person or at least on a Zoom link so that there would be an opportunity for to cross | 01:01:14
examine him. | 01:01:17 | |
So for that reason, we can't allow testimony over the phone. So I apologize for that, but I just want to make it clear to you why | 01:01:21
we won't do that. | 01:01:24
I understood what you're saying. | 01:01:29
I just kind of got him off the phone because he's like, well, I don't know why and he's like. | 01:01:33
I've been on phone things before. I'm like, well, I don't know what this Yeah, I just, yeah, we just want to make it clear. Yeah. | 01:01:36
I'll just let him know, but he's actually the neighborhood that they go through his easement to get through his easement. | 01:01:44
They go through his property, which is the easement to get through his property, if I said that right. | 01:01:50
But yeah. | 01:01:55 | |
Thank you. Well, thank you very much. | 01:01:56
Is there anybody else that wishes to give any testimony at this time? | 01:02:00
Sure, please. | 01:02:04
On on that easement, is it a prescriptive easement or is it a actually the question I guess to? | 01:02:06
Whoever. | 01:02:12 | |
Who, who, who has information on that easement that's being referred to? Does anybody have any information on that? | 01:02:13
Right. I don't know if you right, Yeah. | 01:02:19
Let me check if they put the server. | 01:02:21
If not, Sir, if you, if you wanna address that easy, but if you have information regarding it that we don't the Commission Bell | 01:02:26
would like. | 01:02:30 | |
Ask a question on that. | 01:02:33
Go ahead and step forward please. | 01:02:37
Question on the the the access easement. Is it? Is it a documented? | 01:02:41
Or is it a prescriptive? | 01:02:48
It's, I believe it's documented the easement that comes right off Ladera down into the 52 Ladera. | 01:02:49
That's that's all that. But it's it's. | 01:02:56
It's down on paper that is is is an easement. | 01:02:59
Ohh yes that part is. | 01:03:03
Noted that it is an easement, so he does have to give the right away to that easement. | 01:03:06
I was just wondering if it was prescriptive or it was. | 01:03:10
Because prescriptive easements. | 01:03:13
Go away if things change. | 01:03:15
So if he splits the property. | 01:03:17
Then the prescriptive easement is no longer valid. If it's a, it's a, if it's a platted. | 01:03:19
Still access easement. If he splits the properties, that means it's. That's why I was asking what it is. It is. | 01:03:25
That Mr. Chairman. It might be more helpful to ask the applicant. That question. I think the applicant should know was for | 01:03:33
easement they have. | 01:03:36
Right. | 01:03:40 | |
Go ahead and yeah. | 01:03:41
Go ahead and come on up please. | 01:03:43
It is a document that Eastman. | 01:03:50
And also there are other easements on the property as you can see in the map, there's the four, two acre lots. | 01:03:52
So the property can be accessed from Ladera Rd. | 01:03:58
That that's the one that. | 01:04:02
It gives access to my father's property. That's documented. | 01:04:05
And then there's other there's an easement that makes the like. | 01:04:08
So the one that gives my dad's access runs this way. And then there's another one. | 01:04:11
That goes this way in between the four. | 01:04:16
Acre. So there is other ways to access those. | 01:04:18
Those those properties as well. | 01:04:21
And I wanted to mention that one of the tweaker properties there with a mobile home, it's my grandfather's plant. It's now passed | 01:04:24
down to one of my uncles. | 01:04:28
And we also have an uncle to the other side of of our property. | 01:04:33
And I mean. | 01:04:39 | |
Again. | 01:04:40 | |
Because one of the four, it's my grandfathers. | 01:04:41
That there is access through there as well. | 01:04:44
He has. | 01:04:47 | |
That family member does not have any concern. They're not here today. They're they haven't. | 01:04:48
Brought up their concerns about. | 01:04:52
You know the access to. | 01:04:53
52 Ladera, which is my dad's. | 01:04:56
Property. | 01:04:58 | |
And and then all the lady mentioned a Anisman. | 01:05:00
Being a concern for her, but. | 01:05:03
The easement does not allow access to the the property to the back which is hers. | 01:05:05
It's she access her property through a complete different. | 01:05:09
Road or. | 01:05:13 | |
You know St. | 01:05:14 | |
OK. Thank you. Is that your question? | 01:05:16
Photo because the The Forelands Heaven days. | 01:05:17
Eventually they're using the. | 01:05:21
The issue. | 01:05:23 | |
I said that comment on the paper. | 01:05:24
They all have documented exponents. Understand. | 01:05:28
Because him and blocker. | 01:05:31
You know, my friends. | 01:05:34
Wouldn't the launch? | 01:05:36
That's what the water on my land. I don't understand why. | 01:05:39
Why not? | 01:05:42 | |
No, not remove the loan. | 01:05:43
When finished the using the water. | 01:05:46
Continue to have me every time they using the. | 01:05:49
At least the water I need to. | 01:05:53
You know, for the loan. | 01:05:55
Like a tarp or something that he has. They're holding the water. | 01:05:57
And he irrigates. It doesn't get removed. But again, I I'm sorry, those are the scope of this meeting. Yes, it is. Thank you. | 01:06:01
Milan. | 01:06:09 | |
That's the guidance for me. No problem. The guidance is OK. | 01:06:10
Not that all. | 01:06:14 | |
I don't need to. | 01:06:16
OK. | 01:06:19 | |
Thank you. Thank you. | 01:06:20
Is there anybody else that has questions or would wish to comment on anything that has been said this evening? | 01:06:23
Commissioners, anything else? | 01:06:31
That's incredible. | 01:06:38
I don't. I don't have that access, that's for sure. He was. What were you about to say about the easements? That's something that | 01:06:40
if it's your property, we're not going to be discussing that tonight. You can get with him and figure out your your personal | 01:06:43
easement at a later time, if you will. That easement goes right in front of my property, one of the easements they're talking | 01:06:47
about. | 01:06:51 | |
So and the grandfather passed away. He had moved that gate to block that whole easement to the land, and all of a sudden he wanted | 01:06:55
to move it back for. | 01:06:59
I don't know if it's for them so they could get back and forth on it. | 01:07:03
He said that's the easement between. | 01:07:07
Him and. | 01:07:09 | |
Our property because that that. | 01:07:10
Crosses off our property, so. | 01:07:12
I don't know in that easement. | 01:07:14
If it's actually has to, I have to like allow that or. | 01:07:16
Me and their brother-in-law. I'm not sure what it is, Tim. | 01:07:20
If he moves his fence out, if that easement can be just flopped off, so don't have to be a argument to discussion. | 01:07:24
None of that stuff. | 01:07:31
And all apologize in front of you all. | 01:07:33
I'll start moving the canvases. | 01:07:35
I was putting the cameras so I don't over wet his land. | 01:07:37
Because my land sets in little higher than his, so when I water. | 01:07:40
Water backflow into his gland. | 01:07:44
And I didn't even get him mad about that. Makes noise, can be saying I'm flooding land. | 01:07:46
I'm doing a Picasso and to try and topple because our gates. | 01:07:51
One of the gates is broke, so it hasn't been. | 01:07:54
We on the bottom so water goes under mined lands higher, so the water. | 01:07:57
And it's a kick back to his side, so. | 01:08:01
Of putting the canvas that stops the water from going that way. | 01:08:03
But I'll be sure to try and start moving the canvas from now on. I mean, if you must be in the issue, OK, I'll work on that. | 01:08:07
Thank you. That's I just want to know if you could clarify the easement thing, if it's possible I could talk to them later. No | 01:08:12
matter Dave, do we want to go down that path now or do can you verify his easement? | 01:08:17
No. | 01:08:22 | |
If they have a copy of a recorded easement, that would be the best way to show the board what what exists and what doesn't. I | 01:08:23
mean, I think that's the best evidence, but. | 01:08:27
If it's in the back, yeah. | 01:08:32
OK. | 01:08:34 | |
Very good. | 01:08:35 | |
OK, well. | 01:08:37 | |
We will be making a decision on this one change again after our executive session a little bit later in the meeting. | 01:08:38
OK. | 01:08:43 | |
We'll move on to item number 8. This is also a public hearing. This is Ordinance 2023 regarding. | 01:08:45
The sitting and permitting of wireless telecommunication facilities miss talking you. | 01:08:52
Good evening, Chair and Commissioners. I stand before you this afternoon requesting approval for an ordinance regulating the city | 01:08:59
and permitting of wireless telecommunication facilities. | 01:09:04
The purpose and intent of this ordinance is to protect the health, safety and welfare of the citizens of Valencia County. | 01:09:10
By minimizing the negative impact of wireless telecommunication facilities. | 01:09:16
The ordinance will establish a fair and efficient process for review and approval of applications. | 01:09:22
Per the federal, state and local regulations. | 01:09:28
Encourage the use of. | 01:09:31
Existing facilities. | 01:09:33
Ensure all new facilities are constructed using current technologies that are designed to conceal the site and to accommodate | 01:09:36
further growth. | 01:09:40
And imposed fees for applicants desiring to place a new facility, whether on existing structures or new structures. | 01:09:44
Fees cover the cost of a consultant to advise the county on this highly technical process and I think that's an important to point | 01:09:52
out because we don't necessarily have the staff. | 01:09:56
With that expertise. So we may have to reach out to somebody who does. | 01:10:01
And this should be put on the companies that are requesting. | 01:10:06
The. | 01:10:11 | |
The the tower. | 01:10:12
So again, I am recommending approval. | 01:10:14
For the ordinance regulating the sitting and permitting of wireless telecommunication facilities. | 01:10:17
And I stand for any questions. | 01:10:23
Commissioners, any questions, Miss Amaya? | 01:10:24
Here's your son. | 01:10:30
Thank you. Thank you. | 01:10:31
OK, hit. This time we're gonna go ahead and move on to our action items and item number 14 be moved up, so. | 01:10:36

I don't know if there's anybody here to speak on that, but I. | 01:13:17
I I thought that you did, Mr. Chairman, but I was sitting here, so. But yes, let's go back to that just in case. OK. Thank you. | 01:13:19

There be none. | 01:14:39
We'll go ahead and move on to the action item. Is that, is that OK to do it that way? Yes, it is OK. | 01:14:40

This is approval of the ordinance regulating the sitting and permitting of wireless telecommunications. Miss, I'm here. You can go | 01:14:49
ahead and come up, but I don't think we'll need you to do anything on this one. But. | 01:14:54
Wouldn't come up in case there's questions. Any questions, fellow commissioners on this? | 01:14:59
Sure. No question, yes. | 01:15:03
Is this a this? | 01:15:06
Direction to to publish the ordinance or am I, you know, missing the ordinance here? | 01:15:08
Is this a? Is this? Is there an ordinance? | 01:15:15
To approve here is this Is this just to to? | 01:15:18
My understanding this is an ordinance for approval. That's right that this is the ordinance for approval. It was directed to be | 01:15:22
published I believe last two meetings ago. That's correct. And it was posted in the paper. | 01:15:27
I don't have a. | 01:15:34
Copy of the ordinance, I guess. | 01:15:36
It's not in our packet. | 01:15:41
Sorry. | 01:15:46 | |
Yeah, I I I have the copies here, yes. | 01:15:48
And Mr. Chairman, it's certainly it's it's the discretion of the Board if the Board would like to take additional time to consider | 01:16:14
this certainly you know May. | 01:16:18
You know and and you know I mean. | 01:16:24
And table of the item until the next meeting. I mean if if you would like, otherwise I do have. | 01:16:26
Of two proposed changes which are very very minor on page 8, which would be to just change it to. | 01:16:31
Reflect that the resolutions that are you know that should be setting fees. | 01:16:37
Will be set at a later time. They're not already identified in this ordinance. So I just clarified that language, but it's really | 01:16:43
not of consequence relating to the ordinance itself. | 01:16:47
Issues. Would you wish to table the action on this till next meeting or? | 01:16:52
I think I would just wanted to read I want. | 01:16:57
I am concerned about. | 01:17:01
About promoting appearance and and. | 01:17:04
Using technologies to conceal, I just want to make sure that's not. | 01:17:09
Overly. | 01:17:13 | |
Difficult to do, you know. | 01:17:14
Yeah, I'd like to table it and and. | 01:17:21
No, we don't need to table the public hearing, just the action, is that correct? Correct. Just the action, just the action item, | 01:17:24
it's already been published in anyone who had the opportunity, I mean anyone had the opportunity to show up at this meeting and. | 01:17:29
And. | 01:17:34 | |
Be available to comment. Therefore, it shouldn't be a problem to table it and address it the next meeting, because anyone who is | 01:17:36
interested here would be here or on Zoom to to hear you take that action. Mr. Chairman, just so that we're certain to comply with | 01:17:42
437 Seven, we will republish it and. | 01:17:47
Have that on the next agenda for the board's consideration. | 01:17:53
For the public hearing or just for the action? For the action? | 01:17:56
OK. | 01:18:00 | |
Right. We have a motion to table the action on this particular ordinance. It's item number 9 for tonight is our second. | 01:18:01
2nd. | 01:18:07 | |
Have a motion in a second for tabling any discussion on the motion of the 2nd. | 01:18:07

And the last one is for wages paid on June 2nd, 2023. | 01:19:53
In the amount of 727,000. | 01:19:58
$489.50 and if you can notice, they're all pretty similar in the amount of some of it has. Some of the increases have to do with. | 01:20:02
Overtime, or if we pay nominal fees to our volunteer firefighters, it brings those wages up a little bit, but they they're pretty | 01:20:12
consistent, staying within the same range. | 01:20:17
And with that, I stand for any questions and I do recommend approval of all these packets. Very good. Any questions to Mr. Hill? | 01:20:22
