The Ramsey County zoning rules and regulations are illegal and constitutional government overreach. 00:03:46
Causing undue hardship of the residents. 00:03:52
They deny the reality of the grandfather rule. 00:03:56
And this rule has been upheld in higher courts many times. 00:03:59
Therefore, we have a right to challenge in a court of law. 00:04:03
The ordinance requiring its mobile home space in the county. 00:04:06
To be 840 square feet is illegal and as such can't be enforced. 00:04:10
There is another example of government overreach putting an undue hardship on the residence. 00:04:15
The Constitution gives. 00:04:20
We, the American citizens. 00:04:22
Rights that no local governments can infringe upon. It has come to our attention. 00:04:24
Yeah, most of these rules and ordinances have been done during quote executive sessions. 00:04:29
Behind closed doors, that is also illegal. 00:04:34
Under the laws regarding open meetings, there should not be any closed doors. 00:04:37

Many years after we built our business. 00:04:43
The county zoning comes along. 00:04:46
And it says that we have to tear everything out. 00:04:48
Throw the residents out. 00:04:51
Take down all the power poles and put in underground lines. 00:04:53
This is an unreasonable demand and there's an impossible cost for we the owners, to do. It would also cause us to put people on 00:04:56
the streets. 00:05:00
We built the businesses. 00:05:04
In 1980, under the laws and regulations at the time. 00:05:06
We are grandfathered. 00:05:09
Since we were in business before, there was zoning in Valencia County. 00:05:11
We have complied with every and all requirements. 00:05:15
Including the state EPA. 00:05:18
Now I'm going to skip a little bit here. 00:05:21
My husband is 86 years old and has worked hard all his life to earn an honest living. 00:05:27
We both have been under tremendous emotional and physical mental distress. 00:05:33
The county has passed ordinances and other rules and regulations that should never have been put in place without being on a 00:05:38
ballot. 00:05:41
So that we, the citizens, could vote on them. 00:05:45
Zoning is trying to make us evict many long term residents. 00:05:48
They're living in their RV class mobile homes. That's the only home they have. 00:05:52
We have vets, Native Americans, and several residents. 00:05:57
That are low income and on public health for many reasons. 00:06:00
They are terrified. Where would they go? 00:06:04
We also have residents. 00:06:07
That are healthcare workers on contract. 00:06:09
They live in RV's because they relocate often. 00:06:12
We have workers and Intel, Facebook, Amazon, AUI. 00:06:16
Contract nurses and medical techs. 00:06:20
The rule that they can only stay for four months is a violation of their rights. 00:06:23
The workers have homes in other states. 00:06:27
And the cities, but have jobs here now. 00:06:30
We have kept our rents low so these folks can afford to have a place to live. 00:06:33
With the current situation in America. 00:06:37

This way I just talked to you and you don't answer. 00:08:25
But I ran into Robert Goggin and I came before the Commission because Hoss Foster sent the woman down there to #16 lot. 00:08:28
To throw Mr. Robert Olguin out. 00:08:36
And she he didn't go with written thing. He just went with her, sent the woman down there. 00:08:39
And she told him you had to be out in 30 days. 00:08:45
And then some of the other beers that were there listening got into an argument with the lady. 00:08:48
And she came back. 00:08:54
And she came back here. She was a one day employee. 00:08:55
She told fans foster. I quit. 00:08:59
I'm not gonna persecute people. 00:09:02
So she quit and she went to Farmington, where she was from, and went to work in Farmington. 00:09:04
So that that's just one story about Robert Ocean. 00:09:10

And so he lived there for about four more years until he had a stroke. 00:09:36
And he was already disabled. But he had a stroke. 00:09:42
So they had to move him in with family in another spot. I don't know where he is, but I talked with Robert the other day and he 00:09:44
told me that they they didn't even give me anything in writing. 00:09:50
But now you guys give it in writing. 00:09:55
And and the the. 00:09:58
Things that are out there is the one in writing to throw out the people. 00:10:00

We don't need the news finding out the more veterans are being dislodged. 00:11:36

Residing in this far capital to be. 00:11:49

Which are protected under the BIA. 00:11:55
We don't want them to get involved. 00:11:58
But we will push whatever buttons we need to. 00:12:01

Of the execution of a capital outlay grant. 00:13:48
That was received by the county from the State of Mexico in 2022. 00:13:52
For the paving of our roads in godless states. 00:13:58

I do have a a a prepared statement here, so first of all I'd like to thank the Commission for taking the time to have this meeting 00:17:52
here and allowing us to speak freely on a very pressing issue. 00:17:59
I would like all of you to just please take a moment and look at these people behind me. 00:18:06
Take a look and look into their faces, because this is Valencia County's newest homeless population. 00:18:12
It's a travesty in my opinion. 00:18:19
And I come here today as a partial representative of this community. Obviously they've. 00:18:23
Decided to show up as well. 00:18:28
Currently, the Valencia County Zoning Commission is working towards removing these people from their homes without any 00:18:31
consideration of the adverse effects and hardships that will place these residents under. 00:18:36
The ordinance that affects this community is Ordinance Code 154.173 and 154.172. 00:18:43
The stated purpose of this ordinance is to promote health. 00:18:51
Safety and general welfare of the residents. 00:18:55
Now I ask each and every one of you this. 00:18:59
It does not is denying an elderly couple currently in their 80s their retirement plan. 00:19:02
Promoting health. 00:19:07
Is kicking a veteran. 00:19:09
This room onto the streets promoting safety. 00:19:12
And is contributing to an already overwhelming homeless epidemic truly a move towards promoting general welfare of these 00:19:15
residents? 00:19:20
Our small community is prime is primarily comprised of senior citizens. 00:19:26
Veterans and lower income residents. 00:19:31
Most of whom have found a sense of independence they otherwise wouldn't be able to afford. 00:19:35

Some of even some of these folks have worked tirelessly for years to pay off their home. 00:19:46
They now live in. 00:19:51
And for. 00:19:52
And for this council to see it now uninhabitable simply because it has a living space of 750 square feet versus 840 square feet. 00:19:55
I would just like to know how that's justified. 00:20:04
And I would also like to know who tends to who has the expectation of helping these people? 00:20:08
Is it you, Commission Commissioner Richardson? 00:20:15
Is that you, Commissioner Bizzell? That's going to help Gary? 00:20:18
Finding an affordable home. 00:20:22
Understandably, Los Lunas is currently the second fastest growing city in New Mexico. 00:20:26

And yes, improvements to our community are necessary, and they will be necessary. 00:20:33

I am currently the Vice Commander of the American Legion Outpost City One and also the Veteran Service Officer. 00:27:27
I was just recently addressed with the issue of. 00:27:32
Currently zoning issue that is going to be interrupting the lives of like quite a few individuals that include veterans. So as a 00:27:35
veteran service officer my concerns of opiate helping our veterans and our community is one of my highest priorities. 00:27:42
And so a few few items I want to just bring to the attention of the Council. 00:27:50
If you do choose to actually conduct and follow through with this zoning and and eradicate these individuals or have them move to 00:27:55
another location, is there going to be another means that's going to allow for these low income individuals to provide them a 00:28:00
suitable and a provable housing place for them to provide? 00:28:06
And also I understand that the current issue is that it's an RV. The issues with the RV. 00:28:11
And there's RV's. If you look up the the loan and the loan applications for an RV, they could be classified as permanent 00:28:16

House Bill 68 and 2022 passed the state. The governor signed it and that provided money to. 00:45:03

Valencia County was awarded $525,000 out of that grant over a three-year period. 00:45:14
Once the county did receive the first year's check for a total of $300,000. 00:45:21
In December of. 00:45:26
21st The Commission met and I presented a resolution to the Commission on how to spend that money. 00:45:28
Among those was hiring 4 deputies, hiring bonuses, referral stipend and a retention stipend. 00:45:35
The money has to be spent by the end of the fiscal year as of the end of this month. 00:45:41
And in that resolution I put that any unspent money out of that would be rolled into the stipend. 00:45:45
The MU in front of you is to distribute that to stipend out to the union members of the Sheriff's Office to. 00:45:51
So we can deplete that money and not have to give it back to the state. 00:45:58

Just for your information, the state, I know Dave Patel worked with me a lot on trying to get this on what the requirements from 00:46:06
the state were to pay on this and. 00:46:10

That are healthcare workers on contract. 00:06:09
They live in RV's because they relocate often. 00:06:12
We have workers and Intel, Facebook, Amazon, AUI. 00:06:16
Contract nurses and medical techs. 00:06:20
The rule that they can only stay for four months is a violation of their rights. 00:06:23
The workers have homes in other states. 00:06:27
And the cities, but have jobs here now. 00:06:30
We have kept our rents low so these folks can afford to have a place to live. 00:06:33

Take a look and look into their faces, because this is Valencia County's newest homeless population. 00:18:12
It's a travesty in my opinion. 00:18:19
And I come here today as a partial representative of this community. Obviously they've. 00:18:23
Decided to show up as well. 00:18:28
Currently, the Valencia County Zoning Commission is working towards removing these people from their homes without any 00:18:31
consideration of the adverse effects and hardships that will place these residents under. 00:18:36
The ordinance that affects this community is Ordinance Code 154.173 and 154.172. 00:18:43
The stated purpose of this ordinance is to promote health. 00:18:51
Safety and general welfare of the residents. 00:18:55
Now I ask each and every one of you this. 00:18:59
It does not is denying an elderly couple currently in their 80s their retirement plan. 00:19:02
Promoting health. 00:19:07
Is kicking a veteran. 00:19:09
This room onto the streets promoting safety. 00:19:12
And is contributing to an already overwhelming homeless epidemic truly a move towards promoting general welfare of these 00:19:15
residents? 00:19:20
Our small community is prime is primarily comprised of senior citizens. 00:19:26
Veterans and lower income residents. 00:19:31
Most of whom have found a sense of independence they otherwise wouldn't be able to afford. 00:19:35

I was just recently addressed with the issue of. 00:27:32
Currently zoning issue that is going to be interrupting the lives of like quite a few individuals that include veterans. So as a 00:27:35
veteran service officer my concerns of opiate helping our veterans and our community is one of my highest priorities. 00:27:42
And so a few few items I want to just bring to the attention of the Council. 00:27:50
If you do choose to actually conduct and follow through with this zoning and and eradicate these individuals or have them move to 00:27:55
another location, is there going to be another means that's going to allow for these low income individuals to provide them a 00:28:00
suitable and a provable housing place for them to provide? 00:28:06
And also I understand that the current issue is that it's an RV. The issues with the RV. 00:28:11
And there's RV's. If you look up the the loan and the loan applications for an RV, they could be classified as permanent 00:28:16
residency. And the only thing that classifieds are qualifies for a permanent residency is a bathroom, a kitchen and a sleeping 00:28:22
space. And I believe all these qualify under these homes. 00:28:28
And no matter what type of home we live in, that is our home. 00:28:34
That is what we represent and we stand for. We earned, we we try to build up and make it our own peace and piece of land. 00:28:38
And also if the gentleman that owns the property and he's a sole proprietor and if he has no issues with these, what what gives it 00:28:45
safe for our government to come in and tell them that they can't do this as long as it was is within sanitations everything else 00:28:52
that is covering all the other, I mean for sizing the home by 50 feet by 50 yards. 00:28:59
You know, listening to the stories of these individuals, and I'm new to this topic, I'm, I'm not, I don't know all the details 00:29:06
honestly. My concern is you're going to be kicking out some veterans out of their home and I'm concerned about that. And I and I 00:29:11
promise you if such thing does occur, we will let people know who are the individuals that so decided such a thing for coming up 00:29:16
and coming elections. 00:29:21
Like, you know what? Are these truly the people that we want to be in charge of Our community, our county, and of our community 00:29:27
and our our our community. These are our people, all the people that live here and reside with us. As a veteran, we've stood up 00:29:31

Once the county did receive the first year's check for a total of $300,000. 00:45:21

Among those was hiring 4 deputies, hiring bonuses, referral stipend and a retention stipend. 00:45:35
The money has to be spent by the end of the fiscal year as of the end of this month. 00:45:41
And in that resolution I put that any unspent money out of that would be rolled into the stipend. 00:45:45
The MU in front of you is to distribute that to stipend out to the union members of the Sheriff's Office to. 00:45:51
So we can deplete that money and not have to give it back to the state. 00:45:58
