Good evening. Welcome. This is a regular scheduled public hearing business meeting Valencia County Commission for June 7th, 2023. | 00:00:11
Advance, would you please see us in the pledge? | 00:00:17
To the flag of the United States of America, and to the Republic for which it stands. | 00:00:25
One nation under God, indivisible, with liberty and justice for all. Thank you. | 00:00:30
Welcome everybody. We have quite a few people here, so that's nice to see you. I would ask at this time though, if you would | 00:00:39
please silence any. | 00:00:42
Phones or any other electronic devices that you may have with you. | 00:00:45
Fishers have the agenda before us. Any changes by fellow commissioners? | 00:00:51
I would like to make one recommendation is that I've been asked that item 8 be tabled. | 00:00:57
And the other thing that we have that's just an announcement that is on the agenda is that our July 5th. | 00:01:04
2023 business meeting will be cancelled. | 00:01:09
Are there any other changes, Commissioners? | 00:01:13
Staff Mr. Chairman, If I might, I'd ask that we or the board consider tabling the public hearing item number six. | 00:01:17
As well as action item number seven, additional work is required. We need to work with staff on that sideways ordinance to make | 00:01:24
some additional revisions. We anticipate having that back before the board within the next month. | 00:01:29
Anything else, Danny? Anything for me? No, Mr. Chairman. That's it. | 00:01:36
OK. | 00:01:40 | |
If there are no other changes, is there a recommended recommendation to approve the agenda as amended and that would be tabling | 00:01:41
item number six, item number 7 and item number 8? | 00:01:45
There's a second. | 00:01:54
Motion to 2nd. Any discussion on the motion and 2nd. | 00:01:56
There be no fish rich in your vote Yes Fisher beside your vote yes Mr. Spark in your vote yes Mr. You're on your vote yes I vote | 00:01:59
yes is approved as amended. | 00:02:03
OK, we got one set of minutes. | 00:02:08
And that was from our May 17th, 2023 public hearing business meeting. Are there any changes to those minutes by those missions? | 00:02:10
Is there a non staffing changes on this? | 00:02:20
No, Mr. Jim is a recommendation. | 00:02:22
Sure. | 00:02:25 | |
Please, I'd like to make a motion to approve the Minutes as presented. | 00:02:26
2nd. | 00:02:29 | |
The motion and a second for approval. Any discussion on the motion to 2nd. | 00:02:29
There be none. | 00:02:36
Mr. Hudson Vote. | 00:02:37
Yes, yes, yes. | 00:02:39
That was not present. Thank you. | 00:02:43
And I vote yes with that they they are approved. | 00:02:45
At this point, we'll go ahead and move on to our public comment and we'll get that sheet up here shortly. | 00:02:49
Excuse me, my name is Darla Gleason with just one second, please. I'll be calling you up in the order that. | 00:03:03
Your names appear on the sheet. | 00:03:08
Well OK, one second. I just got this. | 00:03:10
So. | 00:03:17 | |
OK, sorry Missus Gleason. If you would again just come up, state your name and address for the record. | 00:03:25
And I only have 3 minutes, so I'm gonna hurry. | 00:03:37
Valencia County zoning rules Ma'am, would you put the microphone down a little bit so we can hear you? | 00:03:41
Thank you. | 00:03:45 | |
The Ramsey County zoning rules and regulations are illegal and constitutional government overreach. | 00:03:46
Causing undue hardship of the residents. | 00:03:52
They deny the reality of the grandfather rule. | 00:03:56
And this rule has been upheld in higher courts many times. | 00:03:59
Therefore, we have a right to challenge in a court of law. | 00:04:03
The ordinance requiring its mobile home space in the county. | 00:04:06
To be 840 square feet is illegal and as such can't be enforced. | 00:04:10
There is another example of government overreach putting an undue hardship on the residence. | 00:04:15
The Constitution gives. | 00:04:20
We, the American citizens. | 00:04:22
Rights that no local governments can infringe upon. It has come to our attention. | 00:04:24
Yeah, most of these rules and ordinances have been done during quote executive sessions. | 00:04:29
Behind closed doors, that is also illegal. | 00:04:34
Under the laws regarding open meetings, there should not be any closed doors. | 00:04:37
At all. | 00:04:41 | |
Many years after we built our business. | 00:04:43
The county zoning comes along. | 00:04:46
And it says that we have to tear everything out. | 00:04:48
Throw the residents out. | 00:04:51
Take down all the power poles and put in underground lines. | 00:04:53
This is an unreasonable demand and there's an impossible cost for we the owners, to do. It would also cause us to put people on | 00:04:56
the streets. | 00:05:00 | |
We built the businesses. | 00:05:04
In 1980, under the laws and regulations at the time. | 00:05:06
We are grandfathered. | 00:05:09
Since we were in business before, there was zoning in Valencia County. | 00:05:11
We have complied with every and all requirements. | 00:05:15
Including the state EPA. | 00:05:18
Now I'm going to skip a little bit here. | 00:05:21
My husband is 86 years old and has worked hard all his life to earn an honest living. | 00:05:27
We both have been under tremendous emotional and physical mental distress. | 00:05:33
The county has passed ordinances and other rules and regulations that should never have been put in place without being on a | 00:05:38
ballot. | 00:05:41 | |
So that we, the citizens, could vote on them. | 00:05:45
Zoning is trying to make us evict many long term residents. | 00:05:48
They're living in their RV class mobile homes. That's the only home they have. | 00:05:52
We have vets, Native Americans, and several residents. | 00:05:57
That are low income and on public health for many reasons. | 00:06:00
They are terrified. Where would they go? | 00:06:04
We also have residents. | 00:06:07
That are healthcare workers on contract. | 00:06:09
They live in RV's because they relocate often. | 00:06:12
We have workers and Intel, Facebook, Amazon, AUI. | 00:06:16
Contract nurses and medical techs. | 00:06:20
The rule that they can only stay for four months is a violation of their rights. | 00:06:23
The workers have homes in other states. | 00:06:27
And the cities, but have jobs here now. | 00:06:30
We have kept our rents low so these folks can afford to have a place to live. | 00:06:33
With the current situation in America. | 00:06:37
Well, I guess I've got my 3 minutes. OK. Thank you. | 00:06:40
But I'm going to tell you. | 00:06:43
If you pass this. | 00:06:46
We lose 4000 of our income. | 00:06:48
That's pretty damned hard for two people 80 years old. | 00:06:51
Thank you. | 00:06:55 | |
Next, Earl Gleason. And again, for the record, if you'll just state your name and address. | 00:06:57
Flag. | 00:07:06 | |
If you'll just state your name and address for the record, please. | 00:07:09
Ohh. | 00:07:17 | |
Mr. Bozell has been very aggressive with me about filling out the business. | 00:07:18
Form. | 00:07:23 | |
But the business forum that you have. | 00:07:24
Down here where where you read the bottom. | 00:07:27
I wished I had bought my glasses, I guess. | 00:07:29
Get ready. | 00:07:33 | |
But. | 00:07:34 | |
It states that I will comply. | 00:07:35
If I get this signed and I think you knew that, it was going to do that to me. | 00:07:38
That it was going to trap me. | 00:07:43
Because if I comply with signing this. | 00:07:45
And then you guys approve it. | 00:07:48
You're gonna throw all these people out because you already are asking to do it. | 00:07:50
So, so at that point you will even destroy me with two mobile Home Park businesses? | 00:07:54
Now I wanted to explain something. | 00:08:01
A Commission? | 00:08:04
In about. | 00:08:05 | |
Well, it it I had a fellow that rented from me. | 00:08:07
This is the rental agreement. | 00:08:10
His name was Robert Holguin. He had been thrown out of Berlin. | 00:08:12
So I came to the Commission and I guess they accepted me then. | 00:08:16
To talk to the Commission. | 00:08:20
And where you would talk back to me, but. | 00:08:22
This way I just talked to you and you don't answer. | 00:08:25
But I ran into Robert Goggin and I came before the Commission because Hoss Foster sent the woman down there to #16 lot. | 00:08:28
To throw Mr. Robert Olguin out. | 00:08:36
And she he didn't go with written thing. He just went with her, sent the woman down there. | 00:08:39
And she told him you had to be out in 30 days. | 00:08:45
And then some of the other beers that were there listening got into an argument with the lady. | 00:08:48
And she came back. | 00:08:54
And she came back here. She was a one day employee. | 00:08:55
She told fans foster. I quit. | 00:08:59
I'm not gonna persecute people. | 00:09:02
So she quit and she went to Farmington, where she was from, and went to work in Farmington. | 00:09:04
So that that's just one story about Robert Ocean. | 00:09:10
Ohh. | 00:09:13 | |
Back in. | 00:09:16 | |
I've got some notices here too. | 00:09:18
In 2012 was when Robert Hogan moved in. | 00:09:21
But when I came before the Commission. | 00:09:25
The commissioners, I told them what was happening. | 00:09:28
And they come. They voted to leave. Robert Hogan lived there. | 00:09:32
And so he lived there for about four more years until he had a stroke. | 00:09:36
And he was already disabled. But he had a stroke. | 00:09:42
So they had to move him in with family in another spot. I don't know where he is, but I talked with Robert the other day and he | 00:09:44
told me that they they didn't even give me anything in writing. | 00:09:50
But now you guys give it in writing. | 00:09:55
And and the the. | 00:09:58
Things that are out there is the one in writing to throw out the people. | 00:10:00
In in Los Chavez in Mr. Bozelle district. | 00:10:05
Mr. Buzzell says he will not talk to me because I happened to mention the word. | 00:10:09
Thank you, Mr. Lisa. | 00:10:15
OK. | 00:10:17 | |
The three minutes, that is. | 00:10:19
That people are allowed now. | 00:10:22
Is because. | 00:10:23 | |
The commissioner was in Richardson's spot. | 00:10:25
Basically said, we're 3 minutes are up. Thank you. OK. I appreciate your comments. I know you don't like to hear nothing. | 00:10:28
OK, Next Gary Harper. | 00:10:35
And again, if you'll state your name and address for the record please. | 00:10:43
Gary Harper. | 00:10:46 | |
I live in this mobile Home Park to be Gleason's control. | 00:10:47
I've never spoken one of these fandangos before. I feel like I'm running a 4 minute mile. | 00:10:52
I gave 11 years to the service of this nation. | 00:11:00
So that we can live the life that we live. | 00:11:03
And now it seems like it's going to be disrupted all of a sudden. | 00:11:06
Because a few people want to pass some laws. | 00:11:10
I've been 30 years in that mobile Home Park. | 00:11:14
My wife died in that mobile park. | 00:11:17
We are content with the way that we live. | 00:11:20
We just need to leave it be. | 00:11:23
Being a veteran. | 00:11:26
You've heard that there are many veterans in this park. | 00:11:28
Four or five to be exact. | 00:11:31
And right now. | 00:11:34
We don't need the news finding out the more veterans are being dislodged. | 00:11:36
That seems to come up in the news a whole lot. | 00:11:41
And the Indians that they were talking about. | 00:11:45
Residing in this far capital to be. | 00:11:49
Black Mountain. | 00:11:52
Apache. | 00:11:54 | |
Which are protected under the BIA. | 00:11:55
We don't want them to get involved. | 00:11:58
But we will push whatever buttons we need to. | 00:12:01
Slow the momentum of this Commission. | 00:12:04
Got some time left. Thank you much. Thank you, Sir. | 00:12:07
Next is Armando. | 00:12:12
Zuba, I believe. | 00:12:14
Yeah, if you just wait to get up to to the microphone so we can support you. Thank you for your time. Just two points. This reason | 00:12:19
covered most of the earth that I was going to say very good. | 00:12:23
What you will more likely. | 00:12:29
You violating the 1st Amendment. | 00:12:31
To these people and the 4th Amendment. | 00:12:33
By driving them out. | 00:12:36
My only concern other than their my friends and neighbors and choose to live in a smaller residence. | 00:12:38
Is that if the Gleesons can't continue the park then myself, I live in a mobile home and my family will be ousted also because | 00:12:43
they can't afford to keep the the park. | 00:12:48
And I can't afford to move. | 00:12:54
I've been there for 20 years. I'm retired. | 00:12:56
I've got an injury, I've got the disability and you guys are going to force this issue and. | 00:12:58
If that's the case, we need. | 00:13:03
I think we should all get a class action suit against you, each one of you. | 00:13:05
That's my time. Thank you. | 00:13:10
Thank you, Sir. | 00:13:11
Daniel had a meal. | 00:13:14
Hello County Commission Daniel Hamill, 17, Francis Rd. Los Lunas, NM. | 00:13:21
I wanted to come here today and just say thank you to Miss Lena Benavides and her Rd. crew. | 00:13:26
Our roads were in that need of attention and they went out and graded those roads and did an awesome job. | 00:13:33
And we really appreciate them paying that attention to our roads. So thank you so much, ma'am. | 00:13:39
And also that I wanted to add that we look forward and hopefully soon. | 00:13:43
Of the execution of a capital outlay grant. | 00:13:48
That was received by the county from the State of Mexico in 2022. | 00:13:52
For the paving of our roads in godless states. | 00:13:58
And so we look forward to hopefully soon seeing that started. | 00:14:01
To pave our roads because it again, you guys did receive a capital outlay grant. | 00:14:05
To do so, to pay attention to our roads. So again I wanted to say thank you so much for that and hopefully we see something soon | 00:14:10
on that. | 00:14:13 | |
Thank you. Thank you. | 00:14:17
Joe M Moya. | 00:14:21 | |
And Mr. Mayor, if you would just state your name and address for the record, please. | 00:14:29
My name's Joe Moyer and I live in 197 El Cerro Mission. | 00:14:34
I'm going to the tenants there and. | 00:14:39
All I gotta say is that it would be devastating to me because I'm from the 67, I'm disabled, I've had a heart attack. | 00:14:42
I don't know how. | 00:14:52
You start over at this age. | 00:14:53
So all I got to say is at the very heart for not just me, but all the tenants. | 00:14:57
That's that's about all I got. | 00:15:06
And say. | 00:15:08 | |
Thank you very much for your comment. | 00:15:10
Rose rainwater. | 00:15:14
And if you would also state your name for the record, Rose Rainwater, I live at 812 Darla Rd. | 00:15:22
I've been living there. | 00:15:28
27 years. | 00:15:31 | |
My husband died there too. | 00:15:33
And I can't go anywhere. | 00:15:35
I can't afford to go anywhere. I have a good job now. | 00:15:38
But moving that trailer and moving it to somewhere else, it could work for me. | 00:15:41
I'm 60 years old. | 00:15:45
And my mother. | 00:15:48
Is was married to Gary Gleason. | 00:15:49
And she died in the park. | 00:15:52
And I can't afford to go anywhere else. I mean, I have a good job. | 00:15:54
You know, but I can't afford to move my trailer and move it to where I can afford to do anything. | 00:15:58
Because the money I'm saving is just to fix what I can fix. | 00:16:05
But that's it. | 00:16:08
So 27 years in that trailer, It's a long time. | 00:16:11
And I am comfortable there. | 00:16:15
And I can't. I can't. I don't really want to move because I like it there. | 00:16:17
Thank you. | 00:16:23 | |
Thank you. | 00:16:24 | |
OK, we got a. | 00:16:27 | |
Robert Gallegos and the Monique or when are you guys going to be speaking together or separately? | 00:16:29
OK. | 00:16:34 | |
If you both just come up and state your name and address names and address for the record please. | 00:16:36
So I'm only Corona. | 00:16:45
And I live. | 00:16:49 | |
I live in Middle Lake and. | 00:16:50
I live in Solomon Estates, so we are. | 00:16:52
Here to represent. | 00:16:56
Your guys's blue card. | 00:16:58
Union. | 00:16:59 | |
So we would like to thank you for taking the time and consideration for our proposal. | 00:17:00
It will help with the employee retention. | 00:17:05
It will also help with the increase of cost for uniforms due to the type of work our blue collar workers do. | 00:17:07
All of us. | 00:17:13 | |
All of this will left a great weight off the employees and their family shoulders because of the cost of living nowadays. | 00:17:15
Umm. | 00:17:21 | |
We've had a very positive and. | 00:17:22
Very productive experience negotiating with the county. | 00:17:24
And we feel like we've been heard. We feel like they care. | 00:17:28
We're just here again to thank you for your consideration. | 00:17:31
OK. | 00:17:34 | |
Thank you for calling you guys. Appreciate you. | 00:17:35
OK. Next. | 00:17:38 | |
Christopher Stirling. | 00:17:40
Hello, my name is Christopher Sterling. I'm a resident of 812 Darla Rd. SW Unit 16. | 00:17:45
I do have a a a prepared statement here, so first of all I'd like to thank the Commission for taking the time to have this meeting | 00:17:52
here and allowing us to speak freely on a very pressing issue. | 00:17:59
I would like all of you to just please take a moment and look at these people behind me. | 00:18:06
Take a look and look into their faces, because this is Valencia County's newest homeless population. | 00:18:12
It's a travesty in my opinion. | 00:18:19
And I come here today as a partial representative of this community. Obviously they've. | 00:18:23
Decided to show up as well. | 00:18:28
Currently, the Valencia County Zoning Commission is working towards removing these people from their homes without any | 00:18:31
consideration of the adverse effects and hardships that will place these residents under. | 00:18:36
The ordinance that affects this community is Ordinance Code 154.173 and 154.172. | 00:18:43
The stated purpose of this ordinance is to promote health. | 00:18:51
Safety and general welfare of the residents. | 00:18:55
Now I ask each and every one of you this. | 00:18:59
It does not is denying an elderly couple currently in their 80s their retirement plan. | 00:19:02
Promoting health. | 00:19:07
Is kicking a veteran. | 00:19:09
This room onto the streets promoting safety. | 00:19:12
And is contributing to an already overwhelming homeless epidemic truly a move towards promoting general welfare of these | 00:19:15
residents? | 00:19:20 | |
Our small community is prime is primarily comprised of senior citizens. | 00:19:26
Veterans and lower income residents. | 00:19:31
Most of whom have found a sense of independence they otherwise wouldn't be able to afford. | 00:19:35
Excuse me? | 00:19:42 | |
Umm. | 00:19:43 | |
Some of even some of these folks have worked tirelessly for years to pay off their home. | 00:19:46
They now live in. | 00:19:51
And for. | 00:19:52 | |
And for this council to see it now uninhabitable simply because it has a living space of 750 square feet versus 840 square feet. | 00:19:55
I would just like to know how that's justified. | 00:20:04
And I would also like to know who tends to who has the expectation of helping these people? | 00:20:08
Is it you, Commission Commissioner Richardson? | 00:20:15
Is that you, Commissioner Bizzell? That's going to help Gary? | 00:20:18
Finding an affordable home. | 00:20:22
Understandably, Los Lunas is currently the second fastest growing city in New Mexico. | 00:20:26
It's true. | 00:20:31 | |
And yes, improvements to our community are necessary, and they will be necessary. | 00:20:33
And. | 00:20:39 | |
Excuse me here. | 00:20:41
And yes. | 00:20:42 | |
Change will be inevitable. | 00:20:43
But I ask you one last question, excuse me, is growth. | 00:20:46
Improvement. | 00:20:51
And change? Really worth uprooting the lives of the very residents. | 00:20:52
That have contributed to this county for so many years that have kept this county alive for so many years. | 00:20:56
Everybody else has had their 3 minutes and you've had yours. I appreciate it. That's the question I leave you with. Is it really | 00:21:03
worth it? Thank you. | 00:21:06
Harkins. | 00:21:13 | |
This is not we're not gonna tolerate clapping and out outbreaks like that during the the meeting. So please just keep your | 00:21:18
comments and your applause to yourself for now, please. | 00:21:22
Listening to me. | 00:21:27
My name is Jeanette Marcus. | 00:21:30
I live on. | 00:21:33 | |
Darla and Earl's property at 197 Health Settle Mission Rd. | 00:21:34
I'm going to make this easy on everybody. I'll be out in October. Not my choice. | 00:21:38
But by others. | 00:21:43
I cannot keep up with the Joneses since my camper is the smallest one. | 00:21:45
And not the prettiest, so I give up. | 00:21:49
I can't afford a big, fancy mobile home. | 00:21:52
I thought I found my Piece of Heaven on 197 on 7 Mission Rd. Thank you. | 00:21:55
Thank you. | 00:22:01 | |
Next name, I think it's Paul and I'm not sure about the last name. Is there a Paul that's signed up? | 00:22:04
Thank you. | 00:22:11 | |
That's correct. I guess I should. | 00:22:13

Ohh yeah I'm disabled too, but I was saying that. | 00:22:22
Ohh, not trying to take up too much of your time, but I sure don't want to get. | 00:22:27
Put out on the street and put homeless or anything like that, it would be devastating for me and. | 00:22:31
My girlfriend that we lived there and. | 00:22:36
We're just trying to get along with the county. | 00:22:39
If they pass a new Valencia County Zoning Ordinance. | 00:22:41
I didn't know anything about the 800 square feet or. | 00:22:45
The different living. | 00:22:49
I guess, how would you say it? | 00:22:53
Conditions at these different. | 00:22:56
Houses there, some are bigger, some are smaller. | 00:22:58
But well. | 00:23:02 | |
We all have issues with like supply chain shortages. I. | 00:23:04
Worked all my life and worked hard, but it's mostly a lot of shortages and there's nothing I can really do about that and the | 00:23:08
government. | 00:23:11 | |
I don't know if they're going to have another COVID-19 and. | 00:23:15
Pandemic. | 00:23:19 | |
But hopefully not. So that's about all I got to say. I I just don't want to get kicked out of my home. I've been living there. | 00:23:21
All my life. | 00:23:27 | |
Have a nice day. Thank you. God bless you. | 00:23:29
Likewise. | 00:23:31 | |
OK, Diane Colbert. | 00:23:34
If you will also state your name and address for the record. | 00:23:39
If you'll state your name and address for the record, please Diana Colbert. I live at 812 Darla Lane, Space 22. | 00:23:42
And. | 00:23:49 | |
These people have really wonderful. | 00:23:51
Everybody. | 00:23:53 | |
And if you have a problem. | 00:23:55
Rain. Snow. | 00:23:58 | |
This man would be there. | 00:24:00
You know. | 00:24:03 | |
And I have never met some beautiful God. | 00:24:05
Very. | 00:24:09 | |
People. | 00:24:10 | |
And there's a lot of people here that. | 00:24:13
You know, we've been comfortable there. I'm I'm, I'm disabled too. | 00:24:15
I'm retired. | 00:24:19 | |
Was state of New Mexico. | 00:24:21
And right now. | 00:24:24
Just to make ends meet. | 00:24:25
It's, it's. | 00:24:28 | |
Survival. | 00:24:30 | |
And nobody we know inflations here. | 00:24:33
But it's not yet. | 00:24:37
1840. | 00:24:39 | |
We're having enough struggles with government. | 00:24:43
What can you do? | 00:24:46
Give New Mexico break. Aren't you from New Mexico? Don't have a heart. | 00:24:47
Please. | 00:24:53 | |
Tell us what we need to do to save our our. | 00:24:54
Homes. | 00:24:57 | |
Don't just kick us out. | 00:24:59
For human we believe. | 00:25:01
We cry. | 00:25:04 | |
We survive. | 00:25:05 | |
Thank you. | 00:25:08 | |
Thank you. | 00:25:09 | |
Jim Montoya. | 00:25:12 | |
If you'll state your name and address for the record, please. | 00:25:19
Pastor Jim Montoya, 29, Blumenshine. | 00:25:21
Commissioners, I'm here to present a subject matter, not your endorsement, not your approval. | 00:25:25
But to know that we're having a event regarding prayer at the heart, which is a national. | 00:25:31
State, and now we're doing it 20, I mean 33 counties, 23 nations here in New Mexico called prayer at the heart. We're going to be | 00:25:37
praying. | 00:25:41 | |
At the county fairgrounds on July the 1st. | 00:25:46
And what is it all about this prayer? We need prayer. We all need prayer. We need God to intervene in our county. | 00:25:49
In our state, and so we're here. | 00:25:55
Like I say, to invite you all to participate if you so are inclined. | 00:25:58
We're going to, it's going to be from 10:00 o'clock. | 00:26:03
Through 4:00 o'clock. | 00:26:05
On July the first, so I invite you. I'll leave flowers for you all, but I certainly, if I can pray for you, pray God speaks. | 00:26:06
God's love be upon you, God's protection and God meeting the needs of all the people here in Jesus name. Thank you. | 00:26:14
Ohh Sir, Mr. Montoya, did you have Flyers? You're gonna leave us? She said. | 00:26:22
Well, you could just leave to dance with Danny here. | 00:26:27
Thank you. | 00:26:30 | |
Thank you. | 00:26:33 | |
Thank you, thank you, thank you. | 00:26:36
Ohh OK. | 00:26:40 | |
All right. We'll move on to item number 5, discussion on action items. Commissioners, is anything you want to bring to the table | 00:26:42
tonight? | 00:26:45 | |
I didn't see your name on the list, Sir. | 00:26:51
OK, let me just get you to. | 00:26:56
Get your name on the list, so we have a record of that please. | 00:26:59
And I'll give you your time. | 00:27:02
Ship that, Sir. | 00:27:03
So. | 00:27:13 | |
Thank you Sir. If you'll just Sir, if you'll just state your name and address for the record. | 00:27:15
My name is Alfredo Gomez. I live on 6/22 and 1/2 Wisconsin out of Valletta, New Mexico. | 00:27:21
I am currently the Vice Commander of the American Legion Outpost City One and also the Veteran Service Officer. | 00:27:27
I was just recently addressed with the issue of. | 00:27:32
Currently zoning issue that is going to be interrupting the lives of like quite a few individuals that include veterans. So as a | 00:27:35
veteran service officer my concerns of opiate helping our veterans and our community is one of my highest priorities. | 00:27:42
And so a few few items I want to just bring to the attention of the Council. | 00:27:50
If you do choose to actually conduct and follow through with this zoning and and eradicate these individuals or have them move to | 00:27:55
another location, is there going to be another means that's going to allow for these low income individuals to provide them a | 00:28:00
suitable and a provable housing place for them to provide? | 00:28:06
And also I understand that the current issue is that it's an RV. The issues with the RV. | 00:28:11
And there's RV's. If you look up the the loan and the loan applications for an RV, they could be classified as permanent | 00:28:16
residency. And the only thing that classifieds are qualifies for a permanent residency is a bathroom, a kitchen and a sleeping | 00:28:22
space. And I believe all these qualify under these homes. | 00:28:28
And no matter what type of home we live in, that is our home. | 00:28:34
That is what we represent and we stand for. We earned, we we try to build up and make it our own peace and piece of land. | 00:28:38
And also if the gentleman that owns the property and he's a sole proprietor and if he has no issues with these, what what gives it | 00:28:45
safe for our government to come in and tell them that they can't do this as long as it was is within sanitations everything else | 00:28:52
that is covering all the other, I mean for sizing the home by 50 feet by 50 yards. | 00:28:59
You know, listening to the stories of these individuals, and I'm new to this topic, I'm, I'm not, I don't know all the details | 00:29:06
honestly. My concern is you're going to be kicking out some veterans out of their home and I'm concerned about that. And I and I | 00:29:11
promise you if such thing does occur, we will let people know who are the individuals that so decided such a thing for coming up | 00:29:16
and coming elections. | 00:29:21
Like, you know what? Are these truly the people that we want to be in charge of Our community, our county, and of our community | 00:29:27
and our our our community. These are our people, all the people that live here and reside with us. As a veteran, we've stood up | 00:29:31
and defended this nation for that flag, for this state. | 00:29:36
I know we just want everybody to have their own personal right. | 00:29:42
For their own personal view, the liberty and justice their own. | 00:29:44
Choice. | 00:29:48 | |
And and that is what we defended as as veterans of our country and you're asking individuals not to live their life and kick them | 00:29:49
out. | 00:29:53 | |
So again, I want to thank you again for your time for taking the time to listen to our. | 00:29:57
Disputes and. | 00:30:03
And hopefully you guys take to consideration all the different conversations that were spoken today. And I appreciate your time | 00:30:05
today. Thank you, Council. Thank you. | 00:30:09
OK. At this time, we'll go ahead and now move on to item number 5. | 00:30:14
Again, discussion items. Commissioners, is there anything you wish to bring to table this evening? | 00:30:19
Staff and Mr. Chairman, I'd like to have Mr. Silva come up, if you would. | 00:30:26
Good afternoon, Mr. Chairman, Commissioners, thank you for your time today. I want to 1st apologize for not having this | 00:30:33
presentation done earlier, but I just wanted to make sure that it was in fact a dream come true. | 00:30:39
As you all know. | 00:30:46
The Juvenile Justice Advisory Board has been something that. | 00:30:47
It's been a difficult route to to navigate through. I'm happy to say that we have since. | 00:30:51
Made it through the Muddy Waters and we are now in a solid position. We have an excellent working relationship with CYFD. Our | 00:30:57
board is more interactive than ever. We have an enormous. | 00:31:03
A push for a youth subcommittee. Everything is. | 00:31:09
Working. | 00:31:13 | |
As it should be. | 00:31:14
Thank you for your support over the past couple of years. | 00:31:15
Mr. Chairman, Commissioners. | 00:31:18
With that said, I would like to introduce the recently hired Continuum coordinator, Miss Christine Adeline and she would, if she | 00:31:20
would be so kind to address some of the the highlights that we've been working on. Thank you, Mr. | 00:31:27
Good afternoon, commissioners. My name is Christina Dean as Head of mines had mentioned. | 00:31:34
And I am excited to have been appointed this position as I have helped them get up to date with the CYC portal I have. | 00:31:39
Updated all of these surveys. I'm sorry. | 00:31:47
As there have not been any put into the portal. | 00:31:51
And as humans did mention, I do have a great working relationship with HR academics. | 00:31:55
And that is all that I have to say for myself. | 00:32:01
A little nervous, but thank you for allowing me to take this time out of your day. | 00:32:04
Well, thank you for being with us and congratulations and. | 00:32:09
Great to have you on board and we look forward to the continued relationship with you. Thank you so much, Chairman. | 00:32:13
Mr. Chairman, if I may, I'd like to have Miss Benavidez come up to discuss the I CIP workshop that we need to plan. | 00:32:21
OK. | 00:32:27 | |
Good evening, Chairman, Commissioners. | 00:32:28
I've got some days I wanted to run by you for our upcoming CIP which is due August 18th. | 00:32:30
I'd like to see if we could hold a workshop. | 00:32:36
July 19th, right before our regular public hearing business meeting. | 00:32:39
And then hopefully have approval on the final I CIP either August 2nd or 18th. | 00:32:44

Looks good. I think we can make that work. | 00:33:07
Thank you. Thank you. Anything else? | 00:33:09
OK. | 00:33:11 | |
That's all I have, Mr. Chairman. Dan, you sent out an e-mail to remind us all? Yes Sir, I will. Thank you. | 00:33:13
OK. | 00:33:21 | |
Item 6-7 and eight have been tabled, so we'll move on to item number 9. It's approval of a resolution amending Resolution 2023-09, | 00:33:23

Approval of Collective Bargaining Agreement with IAFF Local 5399. | 00:43:07
Mr. *****. | 00:43:12 | |
Mr. Chairman, Members of the Commission. | 00:43:14
Local IF5399 is a newly formed bargaining unit that was approved last year by the public employee. | 00:43:17
Labor Relations Board in Albuquerque. | 00:43:26
We commenced negotiations. | 00:43:29
With the Approved Bargaining Team from both sides. | 00:43:31
We have completed an entire contract. | 00:43:34
With that also includes includes a raise that is consistent with our with our salary study and within the budget. | 00:43:37
The entire contract is. | 00:43:44
Very consistent with our. | 00:43:47
Other union contracts and personnel policies. | 00:43:49
Umm. | 00:43:52 | |
Except of course, it has specific provisions that are related to fire, which are are independent, which are different than you | 00:43:54
know than most of the other employees. | 00:43:58
I think it's a good contract and we worked well with them and I recommend approval. | 00:44:02
If any questions. | 00:44:07
There be no recommendation. | 00:44:09
Sharon like to make a motion to approve as presented. | 00:44:11
Second, have a motion to 2nd for approval. Any discussion on the motion of the 2nd? | 00:44:14
The beginning Commission Richardson, vote yes. Mr. Bizarre. Your vote yes. Sure Spark. When you vote yes, I vote yes is approved. | 00:44:19
OK, item number 15. | 00:44:45
Approval of an MOA with the Valencia County Deputy Sheriff's Association for payment of premium pay. | 00:44:48
Mr. Noah. | 00:44:53 | |
Under Sheriff Nova. | 00:44:55
Chairman, Commissioners, thank you guys for your time. | 00:44:57
Last year. | 00:45:00 | |
House Bill 68 and 2022 passed the state. The governor signed it and that provided money to. | 00:45:03
For law enforcement across the state for recruitment and retention efforts. | 00:45:10
Valencia County was awarded $525,000 out of that grant over a three-year period. | 00:45:14
Once the county did receive the first year's check for a total of $300,000. | 00:45:21
In December of. | 00:45:26
21st The Commission met and I presented a resolution to the Commission on how to spend that money. | 00:45:28
Among those was hiring 4 deputies, hiring bonuses, referral stipend and a retention stipend. | 00:45:35
The money has to be spent by the end of the fiscal year as of the end of this month. | 00:45:41
And in that resolution I put that any unspent money out of that would be rolled into the stipend. | 00:45:45
The MU in front of you is to distribute that to stipend out to the union members of the Sheriff's Office to. | 00:45:51
So we can deplete that money and not have to give it back to the state. | 00:45:58
Umm. | 00:46:02 | |
Just for your information, the state, I know Dave Patel worked with me a lot on trying to get this on what the requirements from | 00:46:06
the state were to pay on this and. | 00:46:10
Was very vague and difficult. | 00:46:16
But it bottom line, it had to be spent on certified officers and not uncertified. | 00:46:19
So being that being said, there would be 34. | 00:46:26
Individuals from the Sheriff's Office receiving that money and 24 of them belonged to the union, that ten of them are non union | 00:46:30
members. | 00:46:33 | |
Umm. | 00:46:37 | |
Working with Loretta on the numbers to cover the Medicare cost to the county. | 00:46:38
There's a small difference that the county has to pick up, which is $3.69. | 00:46:44
I'd rather wanted to round off and not have sense in there, so that's what the counties. | 00:46:49
Difference The county has to pick up on this. | 00:46:55
And the stipend amount to the deputies comes out to 7590 dollars. | 00:46:58
Any questions on any of that questions? | 00:47:08
Period. There is none. Is there a recommendation? | 00:47:13
Mr. Chair, I like to make a motion to approve. | 00:47:16
Second, you have a motion second for approval. Any discussion on the motion of the 2nd? | 00:47:19
There be none. Commissioner Richard, you vote yes. Mission puzzle. Your vote yes. Commissioner Parking your vote yes, I vote yes | 00:47:24
is approved. | 00:47:26 | |
Government commissioners, thank you. | 00:47:29
You guys. | 00:47:32 | |
OK, item number 16. | 00:47:45
Direction to staff regarding Mr. GCD Staging request of 1 Set 160 All Sarah Lucas Soonest, New Mexico. | 00:47:47
Mr. Neff. | 00:47:54 | |
Mr. Chairman, Members of the Commission. | 00:47:56
We received a request from the Mr. GCD. | 00:47:58
For the temporary use of the property at 160 El Cerro Loop. | 00:48:01
And the reason is to store materials. | 00:48:06
As a staging area to improve levies. | 00:48:09
And basically fill. You know they want to store fill dirt and rip wrap and use it as a staging area to. | 00:48:14
Expedite the use in ditch, bank and levy repairs in the area. | 00:48:21
And it's basically to reduce the. | 00:48:25
Repairs intended and the risk of ditches breaking in for and flooding. | 00:48:28
Of course we the county certainly wants to do everything it can to help out its residents and nobody wants to get flooded. So I I | 00:48:33
I would recommend that we. | 00:48:38
Authorize the use of this property as they requested. | 00:48:43
Except with one caveat. They did send us an agreement. Their their form of agreement. | 00:48:46
Which? | 00:48:51 | |
Is basically, I believe, designed for to send to a private property user. | 00:48:52
And it does have a provision in there that requires the release of the RG CD upon execution, which is problematic for a county, | 00:48:56
you know, for a government entity. It's really not a government to government agreement. | 00:49:02
My suggestion would be that a motion would be in order to direct the county manager to approve the agreement. | 00:49:09
Removing the problematic clause and and allowing them to use the property as they see fit at that point. | 00:49:14
Questions Mr. *****. | 00:49:20
There be none as a recommendation. | 00:49:24
Chair. | 00:49:26 | |
Please, I'd like to make a motion to approve it as. | 00:49:27
Adrian. | 00:49:31 | |
Advisors. | 00:49:33 | |
We have a motion for approval making the changes from legal. | 00:49:34
Is there a second? | 00:49:38
2nd. | 00:49:39 | |
The motion and 2nd. Any discussion on the motion of the 2nd. | 00:49:40
There being none, Commissioners, in your vote yes, they should be your vote yes. Parking your vote yes I vote yes is approved as | 00:49:43
amended. | 00:49:46 | |
OK. | 00:49:51 | |
I got the one upcoming meeting to announce June 21st, 2023. We will have a public hearing business meeting. | 00:49:52
At 5:00 O'clock here in the Chambers and also via Facebook live our July 5th, 2023. | 00:49:59
Business meeting has been cancelled. | 00:50:04
And are there any closing comments from fellow commissioners? | 00:50:07
Mr. Chairman, I know I'm not Commissioner, but Mr. Montoya should be right back with those signature pages. | 00:50:10
And with that, we are adjourned. Just stick around, sign that document, then we'll be good. | 00:50:17
Think of the. | 00:50:21 |

If you'll just state your name and address for the record, please yes, my name is Paul Buki. I live at 812 Darla Trailer 22. | 00:22:16

Mr.
